I haven't read the court papers, but there's no way she loses this on PAJA review. Her decision is clearly one in which a reasonable decision maker can come to.

Because the debt would be to SANLAM policy holders, not ABSA...

ABSA has nothing to do in the court or unlawful public protector review.

Don't need to read the papers, she has no legal right to investigate events prior to the founding of her office.

You really need to get a refund on you law course fees...

You could have just left it, but Toxic just has to be right and has to have the last say. If you are with ABSA then it makes sense that you would defend them like you do. You really should be utterly ashamed of yourself.

It IS related because while ABSA was bailing out Bancorp between 1985 - 1994, they then tried to pick up the tab by targeting home owners from 1995 on, because sniping people is their policy.

People are blind as to just how much this bank has stepped and still continues to step on human rights.

That would be another court case and totally unrelated to the matter investigated by the PP.

Bankorp was bailed out when belonging to SANLAM, they are the beneficiaries of the bailout and the fact that ABSA later bought it doesn’t make ABSA a beneficiary.

As judge Davis says it, the government can go after the policyholders and get five rands from each one. It won’t be a very profitable and smart exercise...

Nedbank too, SB too, FNB too, Investec too, haven’t heard of horror stories with Capitec but I’m sure there are some.

Who are you going to bank with?

When you buy an organisation you buy both assets and liabilities.

Law is not for everyone, but from what I have observed in South Africa the past 15 years.... you just need to keep going, even if you fail year on year - a free degree will soon be coming.

Absolutely not, you’re welcome to try to teach me my job, I draft contracts to buy existing entities et least five times a year.

The buyer specifies the liabilities he is willing to assume while leaving the other liabilities with the seller.

In this case, the liabilities regarding the bailout were left with Sanlam.

What are the odds she drops the whole thing by conceding at the last minute. Zuma style. She's obviously being instructed by outside parties
 
This is nothing more than an attempt by the Zuma faction to get revenge or pressure Absa to assist the gupta's with bank accounts.
