It's more like:

"You have 945.16MB bandwidth remaining...after which you will be throttled. If you exceed 2GB you will be suspended."

I phoned them after sending the fax, and when I asked about it they told me to hold on, after 30sec of being on-hold, they ended the call...
my account has not been reactivated btw... :mad:

IMO, WBS' interpretation of 'throttled' means they will strangle you [not just your connection] to death...
 
It could be useful from here on, just from a casual legal standpoint, that anyone who faxes them to get this 'extra bandwidth' -
for the faxes to clearly state that this money is being paid for the reconnection of Internet Access by Iburst AS WELL AS the purchasing of extra bandwidth, which IBurst are requesting in order to reconnect Internet Access.

SUGGESTED FORM LETTER STRUCTURE FOR FAXING IBURST?

"I hereby request the reconnection of my Internet Service by IBurst, who have stated that this reconnection of my Internet Service, will only be done on my payment of monies for what IBurst has chosen to call 'a request for extra bandwidth'.

However, this payment of X is for the reconnection of my account, which IBurst have disconnected. So although this request appears to be simply a request for 'extra bandwidth' - it is in fact, a payment to IBurst, in order to reinstate my (already paid-for) Internet Service, which they have disconnected arbitrarily.

So here is my payment as requested by IBurst in this regard.

I should have realised much sooner that this is why they're wanting 'requests for extra bandwidth' in writing - without any mention of their abritrary disconnections.

Its a legal con, that they're currently doing - and they're covering their own asses against any future actions. 'Disconnections? What disconnections? These are just requests for extra bandwidth!'

I would change this to something like. "I therefore make payment under protest and with full reservation of my rights." But then what do I know, I am not a lawyer!

I phoned them again, and this time they told me, "my request will be passed on to Anthony" Who's Anthony? I thought this was a simple procedure?
 
In pure legalese - and bear in mind I'm a layman - the previous paragraphs referring clearly to the disconnections as being the real reason, and the reference to these being 'arbitrary' and drawing attention to Ibursts choosing to require a so-called 'request for extra bandwidth' for the return of Internet Access - is almost shouting about the clear illegality of their actions and this submitted request, but doing it in quiet legal-style language and tone. A Judge would like the fax, in other words :)
 
BicPen, yeah, if my approach is right, let's see if they try and 'unlink' these two aspects.

Their 'disconnections' with their asking customers to 'request extra bandwidth'.

This linkage of these two clearly in submitted documentation, I think, perhaps puts them in a legally actionable situation. Let's see. If they duck and dive, then we know they've been deliberately behaving in a knowingly deceptive manner towards their customers, and hoping no one will link these two in documentation.

'Anthony' is Anthony McKechnie - I dont know his official title..
 
I spoke to Sassan directly last night for about 40 minutes, the end of which my brain was so numb I just bought another 1GB - dialed up on 56k modem, bought it on iBurst website, called Sassan himself back and my account was reactivated in about 10 minutes.... His number has already been posted by the resident reporter, here it is again: 0827759754. Happy reconnecting.

I was told to make my fax ATT: Dylan Wynic (sp?)

Got connected in under an hour,although it was the day of the disconnections.Late afternoon about 16:00
 
If the legal stuff I've raised is 'true' - then suddenly the request will need to be carefully considered, as it puts IBurst officially, in trouble.
But they can't refuse to accept a letter stating the actual conditions they have required payment under. So its potentially a fun chess game they've now put themselves in.

Go to WBS HQ and put pressure on them directly. Sit in Shaun's office until your account is re-activated!!!!!!! Don't go home. Stay there. Tell them you not leaving until account is active! If they give you grief with that ,tell me about it via PM.
 
you are still settling... you need to send a fax to their legal department contesting it. or else it has no legs... cuz in court they will ask: why did you pay then? why are you here? why are you waisting my time?
 
okay spoken to my lawyer friend to explain this.

you need to refuse to pay and ask to be connected in writing. if they still refuse to connect you then it is illegal. if you pay them then in 'legalities' they are right and you are wrong no matter what you write. i agree with codemasrethti... go to their offices and demand to be reconnected, if they refuse then you can legally do something.
 
Paying is like admitting guilt yes. Pay WBS and you are admiting that you are wrong and WBS is right. For what it is worth, I'm DAMM glad I didn't go the WBS route - although they modem fees is enough already to put me off it for good.

Sorry to hear about all the troubles, but good luck - it makes for good reading ;)
