Rental advise needed

You still haven't answered my question. Is your reading of this that the tenant can stay on at 10% escalation in perpetuity?
This is a very badly worded contract. Technically, yes, since it doesn't say otherwise. Better would have been to state the increase for the following year only, or LL could have left this % amount off entirely and worded it to say a 'market related' increase, which could then easily have him in the position he wants to be in.

Problem is we haven't seen the full contract. Also, I've seen worse. :ROFL:

I'm certain the rest of the contract is just as poor. This clause exposes the LL to this very situation - and in SA, with the law being in favour of the tenant, it won't go well for him.
 
Not OP but similar situation.

Our lease is coming to an end at the end of March. Our landlord wants a 20% increase in rent or to terminate our contract. Renewal we signed was 8% in our current contract.

Anyway we are happy to move and found a place for where we can move 15 February. Can we give him a months notice from today or can he penalise us? (I'm assuming the latter). According to contract he can reasonably penalise us for terminating our lease early but if we wait until the lease ends we might not find a place that fits our needs (Cape Town, shame).

We don't want to squat or fight it we are happy to just leave but ideally without penalty

Read what the contract says. Usually its 2 full months upfront notice to terminate

Chances are that landlord can penalise you for lost rental in March and half of February.

Subtly threaten him. Tell him you're moving to the new place end of story. If he forces you to honour the contract, you'll have no choice but to supplement your income by subletting his place to someone else, like your friend Gary who does drugs and has face tattoos.

The lease says not allowed subleasing but that's funny. Landlord claims they can easily get the rent they want though but I dunno if it was a bluff
