Retrenchments at Telkom put on hold

My logic (and experience) says that morale (and related productivity) at Telkom will dip even further as the period of uncertainty lengthens.

They should have learnt from Sasol. Start at the top. Consolidate companies and retrench the obsolete CEO's. Then work your way down.
Either way, follow proper procedure. Telkom can only improve without all the dead wood.

In a section 189 process you may not use non-performance as a criteria for dismissal. Non-performance must be dealt with via an incapacity process in line with the dismissal requirements in the Labour Relation Act.

It can be used in very exceptional circumstances, especially where employees are already in a corrective program as outlined in an incapacity process. But companies have to be VERY careful not to use retrenchment as a guise to dismiss employees who are not up to standard.

That is probably what makes our labour laws so progressive. And an absolute wet blanket on the economy.

As it is, if the company is serious about downsizing its personnel, surely it can merely close a whole unit, but invite people to apply for specific new positions elsewhere? Then appoint only the people you want to keep in the new units/positions.
(Don't take my speculation too seriously. I know almost nothing about labour law)

:) If only it was so easy. If Telkom were closing down entire units then it could work like that. However.... (there's also one of those!!)...

I've been in numerous Telkom offices - most of the people sit there and do nothing. Just retrench all those people and you can do the same work with 10-20% of the expense.

Actually, some departments serve no purpose other than job creation, the "managers" that thought out that system either really wanted to create mindless jobs that serve no real purpose and could be completely automated, or they are a special kind of retarded.

Telkom must just get on with it. They have too much people, so no question about whether the process should run its course. I will not be too phased about Solidariteit's noise. They are just following the mining union's lead in becoming more aggressive, albeit with different methods. They just shot a few across the bows to scare Telkom.
 
Now what happens to the ones who had already been relieved of their duties?
