ONE would have thought that the communications ministry, notably Minister Ivy Matsepe-Casaburri, would have learnt its lesson by now.

Government often has rational reasons for wishing to increase control over independent bodies. In the case of the Icasa Bill, for example, the communications ministry argues that the new provisions will greatly simplify the appointment of councillors.

That may be so, but the concept sets a dangerous precedent.

why is this so uncritically accepted?? how, exactly, will having Ivy involved simplify anything? have there been issues with the appointment of councillors to date which have not been reported in the press or which we are not aware of? Dep-Minister Padayachee tells us there is political horse-trading under the current system which they want to get rid and allow the Minister to choose competent and qualified peeps and not political appointments....this is absolute nonsense

so the "rationale" for the changes is paper-thin let alone justifiable or compelling

+ we are not only talking out the legal importance of ICASA being independent - we are talking about an industry environment where Govt is major player on many levels and now also wants to control the referee....if this is allowed the regulatory risk to anyone wanting toinve in the industry becos unacceptably high..what guarantees are there that I as an investor competing with a partially-government owned operator will be treated fairly by a government-controlled regulator

by analogy - Barcelona come to SA to play Kaizer Chiefs....Chief's management choose the referee and linesman and let them know that their future employment as officials depends on the way in which they adjudicate the game. If there is a tight call which way are they going to lean?

Mbeki was right to reject the bill. He should do the same with the proposed judicial reforms if they remain unchanged. Independent bodies must remain just that.
