This will be a dangerous precedent they will create.

Because, if one day you are promoted or get a raise and a black person do not like it, he can walk away from work and say that your attitude at work created a lot of stress and reminded him of Apartheid, which caused him to believe that you are superior. Feelings were hurt and he felt oppressed. The result of this could be you ending up unemployed and jailed for 10 years due to getting a raise or bonus.

Dude.. I have seen this happen at work, where people (AA/BEE) don't like their work reviewed (developers), and cry racism. I **** you not...

Yep, I seen this happening too.

The only difference these days is that if you are a white manager who reviewed the work, you could end up in jail if the SAHRC rules in favour of Ashwin, because then your actions could be considered racist and you could be prosecuted under an array of new laws aimed at eradicating white people in SA.
 
I listened to that rout speech that representative gave. Historical context? Every fool knows there is historical context, but that does not mean there is not a contemporary context either. That people's well-being today does not matter. They were saying only black people can be reasonable listeners when considering the impact of hate speech in South Africa. That only black psychological harm matters. Their argument... White people are better off financially. Does that really make our psychological distress any less valid? So one can only assume they reason that therefore white people are legitimate targets for exploitation and abuse with lesser rights. A minority group no less.
I myself am at the point where I do not wish to have children in this country and I dream of leaving for a few years of respite from the never ending accusation before I die. I never did anything wrong. But they want to throw the sins of my father at me. I'm not even bloody religions. They can stick the sins of my father where the sun don't shine. I did nothing apart from contribute to this country my entire adult life. Reasonable one can understand, but EVERYTHING is blamed on white people in this country. I live with depression by and large because of it. The EFF is a violent, and violence encouraging political party. Do they really expect white people to believe that everything Malema has said was not crafted to generate hatred towards white people? They can write that on their foreheads. Malema practically does nothing but encourage hatred towards white people. And not some select white people. All white people. His favourite insult for a fellow black person - That they are practically white themselves. Whiteness itself is according to them a hate worthy evil. Expression of anger is one thing, but Malema is angrily shouting into an emotional echo chamber.

This has set a terrible precedent that the country and millions in it will regret.

I'm sick of being morally disenfranchised. They say Malema would have to literally make a rallying call to violence for it to be counted hate speech. But all a white person has to do is say something negative towards a black person for it to be counted as the most grievous hate speech possible. Worse it sometimes seems than murder in this country. We've seen it many times. The SAHRC has destroyed several white people's lives utterly just because they called a black person some name they do not like. And don't get me wrong. I do not condone it, but it is double standards.

One thing they can be sure of. If they ever make a judgement about hate speech again I will judge their judgement based on whether a rallying call to violence was made. If not - No credibility.

The sad part? It was a white manager dude. Very neutral, just want to best code. We all took it in stride the reviews.. except a few ...

The SAHRC will need to take it to the Equality Court, then pending on the outcome it may even up in the Constitutional Court. Any settlement in this matter will indicate that SS caved.

The SAHRC having the process in the Apartheid Museum may also come back at them when a matter like this end being disputed.

Just to add, they are already taken to the Equality Court in regard to this case, but the case is postponed again and again because the BLF wants to represent themselves, no ‘urgency’ is made by the court. This is a case where the court like to have their time wasted…

But yah, reading that statement by the BLF, they know exactly what was stated by the SAHRC.

I think eusbius uses this argument. Racism is racism. It's a really disturbing argument because now anyone who is not black gets the he/she is automatically racist card or like here for malema it doesn't count. My opinion.

You can click in the middle of the date and type in the year. Poor design as it is not obvious.
