SARS targets bank accounts

Given that SARS is probably the best department of government we have I am quite happy to let them do this. I pay my taxes, why should I or any other tax payer continue to allow wealthy tax dodgers to profit? We all moan about poor service delivery but that wont change without money getting in.
 
That is no brainer do not keep money in bank. Anyway after paying electricity there will be nothing left to take.

If your company does some bad things to your TAX contributions... should SARS take from you or the employer? is there a tribunal to ensure SARS is being fair - who determines what a Tax dodger is? A court of LAW or some kippie at the SARS office?

Its all a good idea when the system is working properly - but what recourse do the people have if they feel they are being treated unfairly.
 
The question is who gave SARS permission to deduct from your account, if not you? And what right do they have in doing so?

Section 99 of the Income Tax Act:
When Sars appoints a third party as its agent under Section 99, such third party is legally obliged to pay any money it may hold on behalf of a taxpayer, over to Sars. It applies to banks holding deposits on behalf of the taxpayer concerned, as well as to employers, who would be required to withhold the amount stated on the Section 99 notice from their employee's remuneration, and pay same over to Sars.

By law, you have to complete a tax return.
If you don't you will be liable for penalties.
If you do and after the assessment you owe sars that money is due and you are given ample opportunity to dispute the assessment. If you don't dispute then you must pay, If you don't pay they will deduct it from your salary. If you don't earn a salary they will deduct it from bank account.

So what is the fuss when SARS is taking what is owed to them.? They do that on a monthly basis anyway...
 
Basically revenue services typically have wide ranging powers, so this does not surprise me. And it's perfectly legal if the law says they can do it. Not perhaps.

:D Depends on where you waiter.:o I made loads more than my tax paying friends were:D But that is who I'm talking about. The people working with cash that earns a load but does not pay income thax and and and.
It's uncommon for waiters to be earning in excess of R40,000 a year. Although even in work like that these days your employer should be holding back 25% as tax.

If I'm not mistaken that was why the rica / fica thing was implemented by banks a few years ago. This means people like Waiters and Taxi drivers that work with cash but have bank accounts will not be able to dodge Mr. tax.
FICA would not help there. Unless you had your bank account in a false name. Otherwise SARS could already check your account and see that you were getting a lot of money in while pretending to have no income.

I made between R15 000 and R18 000 a month.

R40 000 a year??? R3 300 a month!! :eek: Crazy! That means If I work 6 days a week I make R138 tips a day.

I think people on street corners earn more than that.;)

Some people have benefits like cars and stuff and if it is used wrong you owe SARS. That and stuff like if you make profit of the second property you sell and if you have Lotto money in your account you have to pay tax on the rent.

Then Mr SARS wants the money you owe him.

I have never claimed my tax returns or done anything about my tax, should I be worried?

Two things:

1)They don't take it on a monthly basis, your employer deducts it from your salary and pays it over. It's the difference between giving and taking, and even more importantly it's not going into your bank account and then coming back out again.

2)They're not taking the arrears payment, from what I understand, just the fine. Compare it to speed fines - imagine if instead of issuing you with a fine, they just took it out your bank account? Or imagine if they made a mistake and took R20000 instead of R2000?
 
Yea, heaven help the poor bastard who is not contributing towards the government collection of bling.

On the flipside, I did my eFiling Tuesday afternoon about 15h30, and Saturday morning when I woke up, I had a NotifyMe SMS from ABSA stating that money has been deposited into my account. Very efficient. Same story last year. ;)

What sort of things do I use to claim from? My tax that is deducted from my salary?

I do not want to give advise and get you into doodoo.:o I have a tax consultant:o So I get my advice from her.

Your IRP5, medical aid, retirement annuity contribution certificates, etc etc. Your tax gets deducted automatically, but sometimes it is too little and you have to pay in the difference, but more often than not, it's too much, and you get paid the difference! :D

Yeah, they've got a Tax Calculator that will give you an fairly accurate idea of what to expect. In my case, 100% accurate to the cent. ;) One thing to remember is, they put the amount as DUE BY YOU. Should it be a negative amount, that's how much you can expect to get paid, if it's positive, you owe them. And one year I owed about R420 and I just never paid it. I recall getting one SMS saying that I owe SARS, but I just sort of forgot about it, and the next year they paid out what they owed me, minus the R420. :D

About 5 years ago, I owed them something like R18.00, and they sent my nasty letters about if I didn't pay it I would be taken to court and blah blah.

I got all the small change I could find and went to their payment offices and gave them a pile of 5 cent coins. Bastages

Yes - once they've done the ones on the income tax register they'll go after the ones on the PAYE database that never registered to submit their income tax returns.
