Right, let's see if Shamila Batohi follows up on those fighting words she had when she was appointed chief prosecutor.

Sars and treasury to pursue criminal charges against Bain & Co

The South African Revenue Service (Sars) and the national treasury are working with the criminal justice system to pursue a civil complaint and criminal charges against Bain & Company, the Boston-based consultancy which contributed to the destruction of Sars during the tenure of axed commissioner, Tom Moyane.

If Sars commissioner Edward Kieswetter has his way, Bain will turn state’s witness as the tax agency moves to restore the damage inflicted during the Moyane years, he said in an interview with the Mail and Guardian on Tuesday.

Bain developed a flawed operating model at Sars for Moyane, which destroyed much of the tax agency’s capacity, sidelined key senior executives and culminated in a R100-billion decline in tax revenue.

The company has admitted to its role in the destruction of Sars and paid back R217-million, including interest for its work, but according to Kieswetter, this is not nearly enough to repay the agency and the country for the severe damage its work has wrought on Sars and its staff.

Speaking to the M&G on Tuesday, Kieswetter spoke about the extent to which employees lives and careers were destroyed at the tax agency, due to Bain and Moyane’s overhaul of the SARS operating model.

The South African Revenue Service (Sars) has suspended and extended the suspension of executives against whom serious allegations of misconduct were made during the Commission of Inquiry into tax and governance, chaired by retired Supreme Court Judge Robert Nugent.

Sars announced the precautionary suspension of two executives and the extension of the suspension of one executive on Wednesday evening in a statement.

The three executives are Hlengani Mathebula, the Chief Officer for Governance, International Relations, Strategy and Communications, Teboho Mokoena, Chief Officer for Human Capital & Development and Luther Lebelo, the Group Executive for Employee Relations.

During the Nugent Inquiry Mathebula admitted that former SARS commissioner Tom Moyane had a hit list of staff whom he wanted targeted during his tenure as head of enforcement.

He also signed off on what was dubbed as a new “rogue unit” at SARS during his tenure — the unit had apparently targeted Sars investigators who were probing high profile tobacco cases.

Lebelo was described as “Moyane’s hitman” during the inquiry. He was the chief proponent of the alleged rogue unit narrative in SARS but came under fire during the inquiry for having the tax agency foot the bill for his personal legal expenses in preparation for his appearance before Nugent.

The precautionary suspensions follow the revelation in an interview with the Mail and Guardian by Sars commissioner Edward Kieswetter that a special team had been set up in his office to probe revelations emanating from the Commission of Inquiry into State Capture as well as the Nugent inquiry.

“This is part of an ongoing comprehensive review of the whole SARS leadership by the Commissioner in terms of good governance, and further, in response to the report on the Commission of Inquiry into Tax Administration and Governance by SARS, the “Nugent Report”,” Sars said in a statement.

“The precautionary suspensions take effect immediately. It must be reiterated that these suspensions are precautionary in nature and as such do not amount to findings of any wrongdoing on their part.
“A determination in this regard will only be made on the finalization of the process.”

In March and September 2017, Mathebula released media statements, penned by Lebelo and signed off by the then SARS commissioner, Tom Moyane, attacking Judge Dennis Davis, chair of the Davis Tax Committee. This followed comments Judge Davis had made at a conference in Cape Town in 2017 on tax evasion and illicit financial flows that was organised by the Alternative Information Development Centre.

The statements by Mathebula and Lebelo claimed Judge Davis had fabricated evidence and had made himself “party to a systematically orchestrated narrative” intended to undermined Moyane’s leadership.

In her defense, someone has to lodge complaints against the Zuptoids before you can claim she sees no need to investigate them, right?

So while trying to find out if she can investigate of her accord without anyone laying a complaint, I came across the following:
What you need to know before lodging a complaint
The complaint must be against an organ of state and a state functionary. You must have exhausted all available avenues to resolve your complaint.


Made me wonder if she checks that all these EFF and Moyane complainants had exhausted all other available avenues before she leaps up and prioritises them. It is obvious the complaints against the SARS commissioner appointment did not exhaust any other avenues and the ones against Gordhan had already been investigated by law enforcement witch hunters.

I agree on his. Maybe no one is lodging complaints against zuptoids?

The complaint must be against an organ of state and a state functionary. You must have exhausted all available avenues to resolve your complaint.
Depending on definition of "all available avenues", one can basically deny all such requests, isn't it?
