there is some interesting sutff about VANS conversion

1 November and SAT-3 exclusivity appear to have disappeared

Dom is it possible that Paragraph 2 actually leaves it open for ICASA to declare the facilities open before 1 November 2007? Or am I just being an optimistic fool again?

As far as I understand the action of declaring the exclusivity provisions contained in the SAT-3 agreements null and void has nothing to do with the ECA or ICASA. As far as I can tell it is another nonsense item because nothing is really happening. The exclusivity is built into the agreement and expires with the agreement. All the Ivy is really saying is "I've read the confidential SAT-3 agreement and according to this agreement exclusivity falls away as of 1 October 2007."

There's nothing of legal significance happening. There is merely courtesy of notifying the other countries involved that this is our interpretation and that we will proceed based on this.

The policy directive does ask ICASA to declare SAT-3/WASC/SAFE cables as essential facilities. Which is within ECA/ICASA's mandate - although in true DOC style no deadline is given!
