To everyone that says this is bull I'm sorry for you but it isn't.

My father has his own IT company which does a lot of business in with the state. SITA has not paid their bill for over 600 days now, and is also refusing to pay their yearly maintenance fee. If this continues till the 24th of the month my father will be forced to close down his company since he cannot afford to pay his employees.

There you go guys piracy has just cost SA some great local IP, and left 150 people without work. (possibly more because of the ripple effect.)

What's the difference between our situation and that of someone who would just download the software if they could? Both are using it and not paying for it. Thus it is piracy. You do know that illegal copy of windows you have is also a "contract" it's called the terms of use.

You mean other than the glaringly huge difference of commercial vs private use you mean?

Microsoft is a terrible example. They would prefer you pirated their product (which is why its so easy to hack), then use the free opensource alternative.

Because a contract of sale exists between your company and SITA ... hence the term "breach of contract" (it may also be copyright infringement... but any court is unlikely to prosecute it as such).

On the other hand... no agreement of sale exists between the guy who downloads an MP3 tune from a torrent site and the original owner of the work. There was never any intention to purchase the work. so that can only be prosecuted as copyright infringement... and usually only then if the guy who downloaded it actually distributed the work further or profited commercially from it.

Common sense really.

First off, if you are going to be using the English language, use it correctly. Stop changing the meaning of words to suite your argument. Copyright infringement is copyright infringement. Saying its theft is a blatant lie and people will think you are being dishonest and not take you seriously. If you are going to argue about the law make sure you understand it.

I really cannot see how you can distinguish between copyright infringement and theft in the case of using software illegally. As a user of the software you pay a certain fee(usually a purchase price) which then gives you a license to use said software, never to own it. If you don't pay for your license that is theft to me. You are using something without paying for it.

I don't understand how you can call it theft if I take a copy of a cd from a store but change it to copyright infringement as soon as I download it.

Hey wake up! Software in a box is dead and micro payments are in. The piracy bull**** is all about keeping BSA alive to see another day. Apple has shown the world the power of itunes business model. They are turning around an industry previously pirated to hell! But this time they are in control. Keep whining and soon you will not steer the ship at all and someone who provides a guaranteed service at the right price will take control ....

Never mind, pirates don't have any sense of morality in anyway. I'd just find some justice in the world if someone here who's argument was for piracy in the past, was to get sacked come the 25th.

No, you are incorrect. You continue to display your ignorance of the law.

In the first instance there is no charge of theft... since the person has not stolen anything. He has only made a copy of it. He will be charged with copyright infringement.

In the second instance he has physically stolen an actual physical item and he will be charged with theft.

In the first instance a copy was made... and the original left behind.
In the second instance no copy made... and the original was removed.

Seriously, your dads problem has ZERO to do with piracy. If SITA had pirated the goods your dad would have lost R0, spent R0 on procuring the goods they want and then finally spent another R0 on lawyers. Its a breach of contract - they agreed to pay x amount for goods and they never did.
 
This is just a case of big companies trying to explain loss of sales to their board of directors. Who uses microsloth office and pays for it, when you have openoffice for free? Go and have a look at how much microsloth office 2010 is, it is not cheap. Why bother spending lots of money when free software is avaiable that does the same thing? I think the only company that really can whine is microsoft, theirs have got to be the most pirated software ever!

These guys use their name to justify loss of sales, the economic situation lends itself to bad sales, no money means more stuff will be pirated, high prices means more stuff will be pirated, good stolen from things being imported means people wont buy things online, more lack of sales which means more piracy. The ripple effect. If the same movies blu-rays could be produced here is SA, and not have to be shipped in, then surely that would bring the price down of having to buy it. If the price is low enough people will buy it. If the companies got a liscensed distrubutor in SA, surely that would bring the costs of shipping down?

I work with Linux systems... the concept doesnt really exist in my world. We approve of free distribution of our products.

Down with all these people who have more than enough money, but still seek to obtain more of it. Software, games, movies, music, I don't care... Everything for free.
