Some divorce advise please

I know it makes no difference, but how old are you, the wife & the marriage?

We have been married for 7 years, I am 45 and she is 35 no children. In conclusion, thank you for all the advise and comments it is sincerely appreciated. Lastly let me add, a friend of mine always says, "The best divorce, is the worst thing that can happen in your life". Believe me those words are very true.

Third parties have no bearing on a divorce. There is only ONE ground for divorce in SA and that is the irretrievable breakdown of the marriage.

Whether the "breakdown" was caused by adultery or the husband working late too often or the wife not feeding the dogs (silly examples but I hope you get my drift) is IRRELEVANT.

Even a wife who cheated on her husband is entitled to maintenance. The purpose of maintenance has nothing to do with punishing or rewarding someone for their good or bad behaviour.
 
If there is a third party, you can cite him in your divorce papers as the reason for the divorce and can claim damages against him.... but I'm pretty sure you would have to prove it or give sufficient proof.

This wil have to be done in a seperate lawsuit - it is not done together with the divorce.

It is also a bit of an archaic legal remedy. JMO: No human being can ever "possess" another. However much it hurts, if someone prefers to be with another person then so be it. They will get their karma for hurting you and doing it in a deceitful way, but that's a different issue.
