The ANC said on Saturday it will waste no time in lodging an appeal to the Constitutional Court over the banning of the 'shoot the boer' song.

The South Gauteng High Court ruled on Friday that the controversial song is illegal and unconstitutional, following numerous renditions recently displayed by ANC Youth League leader Julius Malema.

The ruling party has instructed their legal team to appeal the decision — an undertaking that has been met with much criticism. But ANC spokesperson Jackson Mthembu said the ruling criminalises the struggle.

"We just instructed our lawyers [to] take this matter to the Constitutional Court as soon as it is possible. Now for any court to say such an instrument is unconstitutional we think its going overboard," Mthembu said.

The idiots will never accept that they are wrong.:mad:
 
Eish! Just where will it stop?

One sect of the ANC is looking to take the fight to the miscreants killing the farmers and the other is doing their damnedest to see "boer" killing become an institution.

This is going to end in tragedy one way or another :(

The mere fact that they want to appeal this judgement casts a really deep shadow over ANC mentality !!!

If that ban gets overturned then the whites in this country better start packing their bags !
 
A song that incites violence and murder is far more unconstitutional than the banning of it. If they want a song that represents the struggle then they can select any number of songs that were written during that time.

The question i want answered is ..Does the ANC feel that the song gives the organization credibility?
 
I know the feeling...My own struggle song which I posted on myBB was also banned :( :p :D

this wasn't even an issue before malema sang it- it was long forgotten, no one cared about it... now all of a sudden this represents everything that they are
 
The ANC are displaying that they can be just as racist as the worst of the old apartheid order. so much for taking this country forward into a new non-racial south africa, we are sliding backwards into violence and racism thanks to them.

I wonder if I write a song with the lyrics "Klap die K@%ir" if the ANC would regard that as not inciting the populace to violence, or "Kom on Opv$%k Julias".

Of course these are offensive, they need to learn to respect others and not associate with those who don't truly appreciate a multicultural democracy.

You know what...this actually makes me wanna get a "Oranje Blanje Blou" flag. If they are allowed to sing crap like this, then how can they throw stones when people use the "K" word? As said above, it goes both ways. Just because u are "previously disadvantaged" does not give you the right to go around singing about killing white people! If anything, you might actually cause people that consider themselves to be on "your" side now, to become racist or think twice before they take another cause up like yours. urg.

I wonder, if all the white people knew then what they know now when they had the "Yes No" referendum back in the days, what they would actually vote. I am not saying having a democracy is a bad thing and that everyone should not have the same rights...but it just seems that a democracy in the hands of a government like this actually means fck all and it yes, perhaps I am being paranoid...but this is starting to scare me.

As I understand it, the problem is that the ruling applies to the phrase itself.

As of now, simply by writing the words "kill the boer", I am in contempt of the court's ruling. If someone wanted to, they could now bring a court case against me simply for using the phrase.

See how tricky this is? The problem isn't the song - it's the people who sing the song.

If the whites were going to do anything they would have done it before 1994.

They got their butt kicked in Bop and there is that group still in jail for attempting to ' take over the country ' ( all by themselves ).

The whites aren't ready, don't have the stomach for it and will just gaan maar aan.

While they are banning songs, could they also ban Beyonce songs. She is singlehandedly killing the radio.
