JUDGE RECANTS FINDING SARS 'ROGUE UNIT' WAS ESTABLISHED, OPERATED UNLAWFULLY

Judge Frank Kroon conceded that the board which he led blindly endorsed the Sikhakane Report and the allegations made by Sars Commissioner Tom Moyane and his deputy Jonas Makwakwa.

Kroon’s report was used as further evidence which ended the careers of numerous Sars officials.
The judge made a staggering revelation related to his board’s endorsement of the claim that the Sars investigation unit was unlawful.

"The statement relating to the unlawfulness of the establishment of the unit were not thought through properly and were in fact incorrect."

Judge Robert Nugent was shocked.

"Are you saying that we did mean to say it was unlawful but on reflection, we shouldn't have said that, because we didn't have a proper basis for saying that? Is that correct?"

"That is correct," Kroon replied.

"Did you put out to the world without hearing anything that they had said?"

"That is correct," sais Kroon.

Malema has a warning for Nene: 'Lie and we will lay perjury charges against you'

EFF leader Julius Malema says his party will approach the courts should Finance Minister Nhlanhla Nene "lie" under oath during his testimony at the commission of inquiry into state capture.

Nene is due to testify on Wednesday at the commission chaired by Deputy Chief Justice Raymond Zondo.

"He must answer honourably. Otherwise, we will approach the court for perjury," Malema told News24.

The finance minister is expected to share details of his 2015 axing by former president Jacob Zuma in December 2015, during his first stint as the head of Treasury.



Nene will also be expected to shed light on his own relationship with the infamous Gupta brothers. On Tuesday, the Business Day reported that he had held several meetings with the family during his first term in office, and while he was deputy finance minister.

Nene at Zondo commission: Questions about the Guptas, answers about the nuclear deal (opinion)

Finance Minister Nhlanhla Nene will on Wednesday admit to meeting members of the infamous Gupta family on up to six occasions while he was minister and deputy minister of finance between 2009 and 2015 – and he will argue it is all about situation and circumstance.

Business Day on Tuesday reported that the meetings were connected to the Public Investment Corporation's investment (PIC) of some R1.3bn into Iqbal Survé's Sekunjalo Investments to facilitate the purchase of the Independent Group. The Guptas wanted in on the deal, in the hope of extending their media empire, but the PIC didn't want the shareholding to change – it must be a PIC-Survé deal, not a PIC-Survé-Gupta deal, was the apparent argument. Peter Bruce gave the same context in his column on BusinessLive on Monday.

Zuma has been careful. Inference can be easily drawn here but did he ever say to Nene - "Sign Nuclear deal or else" - I am just playing devil's non-advocate.

1. Nene said he twice refused to sign off a nuclear deal with Russia because it would have had severe financial implications for the country. He first told former energy minister Tina Joemat-Pettersson that he would not sign off a deal for Russia to provide South Africa with nuclear energy, because it lacked a feasibility study and there were unknown cost implications. He asked her to rewrite the letter, but still refused to put his signature on it.

2. Nene also told the commission that his own colleagues were hostile towards him after he refused to sign off the deal and said rural development minister Maite Nkoana-Mashabane and former minister David Mahlobo accused him of insubordination.

3. Nene also said his Russian counterparts knew very little about the deal and added that, when he questioned them, they told him they were aware of the deal but were not privy to the details.

4. The finance minister admitted that he continued visiting the Guptas' Saxonwold home in 2014, even after National Treasury undertook to investigate the family for the Vrede dairy farm deal with the Free State government.

5. Nene also insisted that he responded to questions the EFF sent to him. The party claimed he ignored questions sent to him through a parliamentary process. Nene even questioned the timing of the EFF's claims linking him to the Guptas, saying he believed it was because he was due to appear before the commission. He denied claims that he assisted with the facilitation of any business deals for the Guptas with the Public Investment Corporation while he was a deputy minister.

While the finance minister admitted to having met the Guptas several times, he previously denied this in a clip that has been widely viewed.
A clip that has been repeated on eNCA today shows finance minister Nhlanhla Nene seemingly caught lying about his links to the controversial family.

In the clip, the minister claims that while he was deputy finance minister or finance minister he only ever saw the Guptas at public gatherings, and has never been invited to any “engagements” with the Indian-born businessmen widely believed to have played a role in capturing the South African state.

This directly contradicts his evidence at the commission of inquiry into state capture on Wednesday, where he told the inquiry’s chairperson Justice Raymond Zondo that he had met with the family four times between 2010 and 2013, while he was indeed deputy minister of finance.

Nene also mentioned a fifth meeting, alleging that Ajay Gupta had used it as an opportunity to try extract information from him.
