What sort of penalties is ICASA allowed to impose?

Loaded question-
Theoretically, or practically; under old regulatory regime, under current 'transition stage', or envisioned by ECA/IAA?

Related to this, anyone in the know expect 'forum-shopping' to be a problem under new laws, or has this been sufficiently covered? ('Forum-shopping' - looking for the body with least amount of fining/penalty-imposing powers. Like Telkom has been doing with ICASA and Competition Commission- trying to argue that the less powerful body has jurisdiction instead of the more powerful one.)

1. Let them implement MNP when they feel like it,,, until such a time though, contract customers who's contracts expire should not be obligated to resign. They should be allowed to continue on a month to month basis with all the previous benefits of the contract.
Seems fair!

2. Additionally, a further deadline must then be set (not going past mid Nov) that the providers have to comply with.
Failing to do so must result in punitive action, fines every month (% of turnover) until they come to the party.

1 is certainly not an unreasonable request, 2 well I probably have more chance of getting cozy with Penelope Cruz quite frankly

They are purposefully dragging their feet and will only take it seriously when it hits them where it hurts, their pockets.

They already are afaik - at least I know thats the case on Vodacom. I havent renewed my contract in ages.

EDIT - But I agree - penalties must be handed out.

Ditto. Mine is also in such a suspended state.

As far as the penalties thing go... ja well no fine. :rolleyes:

I see that the networks will not be implementing MNP by 17 September and have once again asked for an extention.

I was about to cancel my contract with MTN and switch to CellC last year sometime, when I heard about MNP. I decided that it would be nice to keep my number, so I waited until December.

To my surprise, the networks could not implement it in time. I again decided that that I would wait until July and then switch to CellC. Once again they did not meet the deadline.

Then Virgin entered the market and I got myself a SIM card so that I could test their network before MNP kicks in. I was so excited as the networks lead us to believe that they were ready for MNP! Now I see that they are once again asking for a extention... this is unacceptable!

I have been staying with MTN for more than a year now because I am waiting for MNP. If I knew it was going to take this long, I would have cancelled my contract with MTN then and just sent everybody I know my new cellphone number.

I don't see why they are taking this long as there are many companies in other coutries doing the exact same thing. They could source the technology from them.

Please impose the penalties on them! This is the quickest way (and by the looks of things, the only way) that they will implement MNP!!
 
Penalty should be - for every day delayed, service prices are to decrease by 1%.

Watch them say the next day that MNP has been implemented successfully.
 
How about a million rand a day per operator that should sort out the ICASA staffing issues? The ICASA blokes should do like the traffic cops do for Christmas bonuses, start fining like crazy to generate more income.
