I understand that, hence the article suggests that those that are retrenched wont be able to claim. Im sure that meant that if they resign , then obviously they wont qualify for any UIF.
Also , abit OT..... when one retires and goes on pension, can one still claim UIF ?
According to information from a union involved in the negotiations, Telkom staff members who take the latest packages will be deemed as being retrenched, and will hence be eligible to claim unemployment benefits.
Not sure how you interpret the article to suggest that, when it clearly states that they are eligible to claim UIF. Here it is again:
Regardless of that, the Law clearly states that anyone who has contributed to the UIF fund will be able to claim if they are retrenched. As MickeyD mentioned.
Retirement is just that, retirement. All you can claim is pension, definitely not UIF. So those choosing to go on early retirement will be able to get their pension benefits earlier, probably coupled with a lump sum, but cannot stand in the UIF queue.
Agreed. Like another poster said, they usually let the skilled people that they actually need go, and keep the useless ****s that screw everything up, around.
According to a source close to the unions, Telkom is likely to target management staff next, where levels will be determined by the number of non-management staff members who take the voluntary packages.
Seriously doubt that. In all their previous rounds management has always reserved the right to refuse any applications. So are they going to close the sections where the most people leave? I mean seriously, are they smoking pot or are they just busy winding up all outstanding business at Telkom? Surely you target retrenchments based on operational requirements?

Nope. The law differentiates between being retrenched (where you have no say in it) and voluntary retrenchments (where it is your choice to leave).
If you choose to leave a job voluntarily (and get paid something in addition to the regular severance package) why should you also get to claim UIF?
150% correct.
It's always the useless lot that stay behind, cos they know that they won't be able to make it outside.
True for voluntary early retirements but you forgot about the voluntary severance packages for the under 50's.You got it very wrong, this is offered to over 50s, they are also many inefficient old school thinkers.Telkom has to trim top heavy, spend more on non-core business.
Nope, you are deemed as being a retired pensioner, not quite the same as an unemployed job seeker. And what about those that have been a loyal servant for 40+ years at a company. Where does all those contributions go to ?
Surely when you are retired, you are deemed unemployed ?

hmm good point, but then retrenchment is not normally a voluntary process. That said, I believe the Labour Court has the power to make rulings in special circumstances, especially where such big companies are involved.

Also been there before, have you? There are such things as special dispensations. The Telkom voluntary retrenchments are seen as retrenchments by the department of labour and SARS, you also pay reduced tax on the package payout.
Correct. Arrangements are made with both dept. of labour & sars.
