Telkom uncapped and fair use limits uncertainty

So I can put out some false / inaccurate ad, rope in many customers and nail them until someone complains to ASA. Once that happens, I can quickly change the TOCs / ad and get away scot free?
Never understood how this is acceptable. The guilty parties should either be made to honor their misleading ads or be given a large fine, IMO. I'm sure 80% (thumbsuck) of these companies know full well what they're doing is wrong. They go ahead anyways, because they know they'll schny many people and when found out, get away with a warning. Just doesn't seem right.
 
The ASA has a long standing principle not to rule on the matter if the advertiser amends or withdraws the advertisement. It therefore accepted Telkom’s response without considering the merits of the matter.
ASA needs to revise this "principle"
 
The ASA needs to grow some balls...

Rather than forcing the company to amend the advert, they must force the company to adhere to the advert, for the duration the advert with the misleading statement was available...
 
lol, I don't disagree in principle. My view is just that considering the framework they are sitting with the ASA has balls in the plenty
 
So what is the fair use policy limit of telkom uncapped?
 
"you can use as much as you want that we allow?"
