What was meant to be a straightforward leave for appeal in the North Gauteng High Court turned into a mud-slinging match between the judge and a lawyer for the SAPS, during an application by lobby group Freedom Under Law to prevent former crime intelligence boss Richard Mdluli from returning to work until the charges against him are heard in court.

This Moharri is a senior advocate charging around R16000.00 a day. Appearing for the police probably more.

Yet he ignores a judge.

The result?

The Judge walks out and the case gets postponed indefinitely.

They will have to find a new court date and new counsel. This judge is not going to listen to this Moharri again.

Mduli stays suspended and nobody wins. The judge has to come to work tomorrow as he has done the last 30 years.

Then the black lawyers forum accuses all and sundry that they are racists because they don't use black counsel.

I rest my case.

Judge is an idiot. He should have held this arrogant prick in contempt and had him removed.

Indeed. Judges are way too lax these days.

They should also hold the Tshwane mayor in contempt for not responding to a court order to put the old street names back up.

That advocate .... a rude, arrogant, douchebag of note. Where does he get off talking to a judge like that???? If a judge tells you to keep quiet, you zip it.

No wonder certain sectors of society, not to mention certain political parties and figures, have no respect for the Court and its judgments. And the worst is that this idiot will probably play the race card now.

FFS, no matter who you are and what your skin colour, you show respect for the Court!
 
I find it weird that nobody wants to discuss the merits of this case, even experts like Pierre De Vos who write so religiously on court matters of great importance. Since this case is a precedence then I would have expected to see it's mertis discussed at length.

As for the clash between the judge and the advocate, I think the advocate should not have used the selection of the language that he used, i.e "I will not respond to that question" instead of saying "I have no indulged the commissioner on the matter so I would not be able to answer that question". He is obliged to respond to the judge! But then the judge showed his immaturity by not asking the advocate to get the position of the commissioner on the matter, instead of insisting on the answer when it was clear that the advocate doesn't have the commissioner's view on the matter, which he didn't have a reason to since this is an application for leave to appeal not the case about the interdict itself.

One last thing. People are born in sin, which leads to them showing behaviour that is consistent with their sinful nature. Racism is one such behaviour. People don't get taught to be racist, but they naturally become one. Both black and white people are racist by nature, hence it's not surprising to see the comments we see here. The bible likens racism (hatred of one person/race for no justifiable reason) as murder, and all murderers will have their part in the lake of fire. Repent from this racism, and trust in Jesus for forgiveness of your racist behaviour.
