A man was arrested in Rynfield, Benoni, on Friday for shooting dead two men in a domestic dispute, Gauteng police said.

The 47-year-old man shot his daughter's 20-year-old boyfriend and the boyfriend's 46-year-old father around 8.30pm on Thursday, said Captain Julia Claasen.

"The 47-year-old suspect was arrested and will be facing two counts of murder charges. He will appear in the Benoni Magistrate's Court on Monday."

Police were investigating.

Benoni father in court

A father who allegedly shot dead his daughter's boyfriend and the young man's father is expected to appear in the Boksburg Magistrate's Court on Friday.

Retief Liebenberg of Benoni was arrested last Thursday in connection with the shooting of 19-year-old Dewalt “Poena” Visser - his daughter Chevonne's boyfriend - and the boy's father Dewalt Visser, 46, in his home.

The Beeld reported that Liebenberg did not approve of the relationship between Poena and Chevonne as he had heard rumours that Poena was taking drugs.

He arrived at his home in the Ebotse Golf Estate in Rynfield, Benoni, that day to find Poena in the house, after he had apparently banned his daughter from seeing him.

He appeared in the same court on November 5 but the case was postponed.

Benoni bail bid going ahead

The State on Friday abandoned a bid to have the bail application of a man who allegedly killed his daughter's boyfriend and father postponed in the Benoni Magistrate's Court.

Retief Liebenberg of Benoni, Johannesburg, was arrested last Thursday in connection with the shooting of his daughter Chevonne's boyfriend, 19-year-old Dewalt "Poena" Visser and the boy's father Dewalt Visser, 46, in his home. Liebenberg is facing two counts of murder.

Prosecutor Thabiso Mosikili earlier indicated that the State had not obtained a statement from Chevonne Liebenberg. He said she was not well and in a bad emotional state.

Her statement would enable the State to change the offence from a schedule five to a schedule six one, Mosikili said.

In terms of schedule six of the Criminal Procedure Act, an accused can only get bail if he or she proves that exceptional circumstances exist for it to be granted. Schedule five and six offences include murder, rape, and robbery.

Marius van Wyngaardt, for Liebenberg, said the State had had enough time since the last appearance on Monday to obtain the statement.

The defence was only aware of the offence being under schedule five and not six, he said.

"The State have enough documentation from witnesses. I oppose further postponement and ask that we proceed with the application."

Van Wyngaardt said he would not oppose the State's bid to change the crime to a schedule six offence.

Mosikili then abandoned his bid for a postponement. Magistrate Ian Cox allowed the hearing to continue.

Benoni murder scene was 'staged' : Cop

The scene of Dewalt Visser and his teenage son's murder had been tampered with, the Benoni Magistrate's Court heard on Friday.

"The scene had been tampered with and reconstructed," investigating officer Warrant Officer Peter Mbonani testified.

"The number of bullet holes were more and did not match that of cartridges found at the scene."

Retief Liebenberg, of Benoni, Johannesburg, was arrested last Thursday in connection with the shooting of his daughter Chevonne's boyfriend, 19-year-old Dewalt "Poena" Visser, and the teenager's father Dewalt, 46, in his home.

Liebenberg, who faces two counts of murder, was applying for bail.

Mbonani said Visser jun. visited Chevonne at Liebenberg's home that day.

"The witness who was with the deceased said Visser senior received a call from his son on that day who told him the accused [Liebenberg] was holding him hostage in the house."

The two, Visser sen. and the witness, drove to Liebenberg's home. They arrived and spoke to Liebenberg, and the situation was amicably resolved, he said.

As they were about to leave with Visser jun., Liebenberg went around the house and fired shots at the father and son, Mbonani said.

"The father was shot five times in the front of the upper body... the son ran away and the accused followed him to the kitchen," he said.

The teenager was shot while lying on the floor. Both were declared dead on the scene, the court heard.

Asked by prosecutor Thabiso Mosikili who constructed the murder scene, Mbonani said he did not know.

Liebenberg runs his own company and has 70 people in his employ. He and his wife are divorced, and he lives with their two children -- Chevonne and a son.

In his affidavit, read by his lawyer Marius van Wyngaardt, Liebenberg said being granted bail would enable him to look after his business and his children who depended on him.

The business would have to close down if he remained in custody and his employees' jobs would be in jeopardy.

A report by a clinical psychologist indicated that Liebenberg was traumatised by the crime and suffered from depression. He needed treatment before his condition worsened, the court heard.

The bail hearing continues.

Murder accused Retief Liebenberg's life could be endangered if he was granted bail, the Benoni Magistrate's Court heard on Friday.

"The family of the deceased are very emotional about the crime. The accused could face danger if granted bail," investigating officer Warrant Officer Peter Mbonani testified.

Liebenberg, of Benoni, Johannesburg, was arrested last Thursday in connection with the shooting of his daughter Chevonne's boyfriend, 19-year-old Dewalt "Poena" Visser, and the teenager's father Dewalt, 46, in his home.

Liebenberg, who faces two counts of murder, was applying for bail.

The father and son were buried earlier on Friday in the local suburb of Rynfield.

Liebenberg, who wore a blue shirt, a tie, and a checkered jacket sat motionless in the dock as he listened to proceedings. Mbonani testified that Liebenberg shot and killed Visser sen. and his son at his home.

The murder scene had been tampered with, he told the court.

Marius van Wyngaardt, for Liebenberg, asked Mbonani how he could make this claim when he had not yet seen the ballistic report.

Mbonani said one could clearly see at the scene that Liebenberg, after shooting Visser sen, continued shooting as he went into the house and followed Visser jun. who had run to the kitchen.

"The bullet holes and marks on the walls showed that the accused continued to shoot. Some of the bullets grazed the walls," he said.

Van Wyngaardt told Mbonani he was misleading the court. Magistrate Ian Cox suggested to Van Wyngaardt that he wait for the ballistic report before he asked about the scene as it was obvious he did not believe Mbonani.

Van Wyngaardt insisted he proceed as Mbonani had inspected the scene and seen photographs taken of it.

"There is a possibility that what the photographs show could differ from what ballistic experts come up with," Cox told Wyngaardt.

Cox postponed the matter to November 15 for ballistic evidence to be made available to the court. He allowed Van Wyngaardt's plea with the court to have his client remain at the Benoni police station cells, and not at a prison cell.

Liebenberg needed to receive treatment for depression as ordered by the clinal psychologist in an affidavit presented in court, he said.

"My client's condition could further worsen and he might not stand trial if placed in a prison cell... it would be difficult to render him the treatment he needs."

Meddling in Benoni murder case

An East Rand man accused of killing his daughter's boyfriend and the boy's father received preferential treatment while in custody, a magistrate said on Friday.

He reacting to information that Retief Liebenberg was not taken to Benoni Magistrate's Court in a police vehicle for his bail application. He arrived in a private car.

Presiding Magistrate Ian Cox said it was obvious that Liebenberg was receiving preferential treatment.

"He is receiving preferential treatment and I won't stand for it," said Cox.

Liebenberg had been kept in custody at the Benoni police holding cells prior to the court proceedings.

He allegedly shot dead Dewalt Visser Jnr -- also known as Poena -- and his father Dewalt at his home on October 31.

Retief had apparently barred his daughter Chevonne from seeing Poena as he believed the boy had been using drugs.

Earlier, the court heard that Poena called his father, telling him that Retief was holding him hostage.

Dewalt rushed to the scene. Liebenberg allegedly shot him five times in the upper chest. Poena was also shot.

Both men died on the scene.

Benoni dad gets bail

A Benoni father accused of shooting dead his daughter's boyfriend and the youth's father was granted R50,000 bail in the Benoni's Magistrate Court on Friday.

Dressed in a brown suit and blue shirt, Retief Liebenberg left the court from a side-door as his family feared for his safety.

He will be back in court on December 11.

As part of the bail conditions, Magistrate Ian Cox said Liebenberg should report to the charge office every Monday, Wednesday and Friday. He was not to apply for a new passport as his previous one had expired.

Liebenberg was alleged to have shot dead Dewalt Visser Snr, 46, and his son Dewalt Visser Jnr, 19, at his home in Rynfield on October 31.

It was alleged that Visser Snr had called his dad to the Liebenberg residence, saying that Liebenberg was holding him hostage.

His father arrived at the house and was shot five times in the upper body, allegedly by Liebenberg.

Visser Jnr was also shot at the residence.

Both men died on the scene.

It was alleged that Visser Snr had called his father to the Liebenberg residence, saying that Liebenberg was holding him hostage.

His father arrived at the house and was shot five times in the upper body, allegedly by Liebenberg.

Visser Jnr was also shot at the residence.

Liebenberg had apparently barred his daughter from seeing Visser Jnr, as he believed the young man was using drugs.

Liebenberg was granted R50,000 bail in November last year.

The investigating officer, Warrant Officer Peter Mbonani, told the court at the time that Liebenberg's defence and some police officers were meddling in the case.

Liebenberg's legal team denied they were interfering in the case.

Mkay then, definitely rules out accidental.
 
Amazing how everyone who commits a heinous crime these days is mentally unfit/depressed/suicidal/insert whatever excuse is good for the day.
 
Self-defence or calculated execution?

Johannesburg - Was Benoni businessman Retief Liebenberg an overprotective dad who deliberately shot dead his daughter’s problematic boyfriend and his father?

Did he execute them to get rid of them, or did he snap after bottling up emotions for a long time and genuinely cannot remember shooting them?

These are the questions Pretoria High Court Judge Mahomed Ismail will have to determine when he decides on Liebenberg’s fate.

The 50-year-old is facing two charges of murder after the shooting of Dewald Visser, 47, and his son, Poena, 19.

The pair were gunned down in Liebenberg’s home on October 31, 2013.

Liebenberg pleaded not guilty.

He said he shot and killed the pair in self-defence.

He also claimed he suffered from amnesia and could not recall firing nine shots – five which hit the father and four Poena.

Is this the same Poena that used to be seen driving around Benoni in that Focus ST with the Poena number plate? Now that I think about it, it has been a while since I've seen that car around.
