If I am not mistaken, the two main deciding factors in Mombergs case was that she showed no remorse for her outburst combined with the particular word used, I think that if this does go to court I doubt it will have the same outcome because the defendant will simply show remorse in the form of a apology.
PS Not defending the person in the video, its still blatant racism.
What I find more disturbing is the several comments on twitter where they claim its "simple swearing" just glad there is a person or two responding to those setting them straight.
