Just remember if you get caught you go to jail, thats defeating the ends of justice.

Defeating the gantry detection system with these flip-plates probably won't be defined as defeating the "end of justice". The ends/course of justice refers to criminal/civil cases being defeated where the person foresaw the possibility that in the ordinarily course of events the case will land up in court - does/will the non-payment of e-tolls ordinarily land you before a court of law? If not, no ends/course of justice was defeated.

Im willing to put money on it that its a criminal offence to use that system

It is. The road traffic act prohibits installation of anything not part of the car's original equipment within 15cm of the number plate.

from the AARTO offences, the closest I could find, would be
"Vehicle with licence numbers which were in any way obscured or had become illegible - Reg. 35(6)(b)"
for which the fine/penalty would be
"this is a criminal offence and no fine has been set for this offence. It requires a court appearance. Typically sentences and fines set by a magistrates for these offences will also carry a criminal record if you are found, plead or admit to being guilty of this offence. Magistrates may also sentence offenders to a jail term, correctional supervision etc."

Not even talking about AARTO. This is a criminal offense, you are knowingly changing something on your vehicle to stop authorities from identifying you. Straight to jail
 
How is this any different to bikes with NO plates, that equals a small fine usually. Its still intent to hide identity

2 very different things.
One is specifically relating to the RTA.
The other is far more severe.
You are knowingly doing something that could defeat the ends of justice, for example being photographed, fleeing a scene of accident. That falls under the CPA

Knowingly removing my nr plate or flipping it in transit, is the same in my view

but would 'owning' a flipper, make you guilty of using it, or would they have to have proof that you have used it?

If so, there should be a law that states flippers are illegal and we would all know

not the same in the eyes of the law. I guess a cop if he wanted to, could detain you for the plates issue. He would have to prove intent I suppose. If he sees you flipping your plate, there is the intention to defeat the law.

Id agree that being caught flipping it will be a big issue
