No, that's not how it works.


In other words, all nation-states that are members of the United Nations are legally bound to reject the notion of Right of Conquest as far as territorial acquisition is concerned. So as far as other members of the UN are concerned, they are legally obligated to treat the governments of Syria and Iraq as the legitimate authority over the land contained within the national borders of those two states respectively, along with all the other legal consequences that follow naturally from this legal obligation.

IS don't agree with you, and they are not a member of the UN.

Maybe you should go and talk to them. But don't lose your head.

IS is irrelevant here. What IS does or does not do is completely immaterial as far as the legal prerogative the Iraqis and Syrians have to complain about their national airspace being violated by foreign powers. IS cannot take that prerogative away short of completely destroying the Syrian or Iraqi governments which clearly they have not managed to do.

The Turks were on the ground in IS territory, so this has everything to do with IS. Nothing to do with airspace/flights.

But let's cease this argument, this is stupid, it's really about how IS doesn't care about anybody else, and we all know that.

There is no legal "IS territory" just like if you suffered a home invasion the invaders wouldn't suddenly become the legal owners of your house.

I said you were naive OR trolling, are you really that naive to not be able to tell the difference between a nation state and a group of criminals? I'm not so sure you are, alternative theory back into play...

They can't really get rid of ISIS without Al-Qaeda stepping in, a constant power struggle.

IS doesn't care about International Law, but countries do care about International Law. Thus, they are obligated to obey the legal prescriptions which restrict how they may legally behave or they face legal censure for their actions.

There is no way around this, and other nation-states are obligated to respect the wishes of the Iraqi and Syrian governments with respect to the airspace and land that they are legally entitled to.

Yes, I agree.

But the UK, France, USA, etc, all seem to have legal arguments that covers their arses. Mainly based on self-defence.

And Russia has invaded the Crimea and Ukraine, so everybody seems to do what they feel like doing.

Not sure why Iraq is getting excited about a few Turks running around in IS territory.

But, yes, I agree with you that they have a right to complain.

FFS, why don't you get the fact there is no such thing as IS territory? a gang of criminals don't constitute a nation nor do they have legal territory. The Turkish troops are in Iraqi territory.

The concept of the home invaders not owning the house they break into should be fairly easy for almost anyone to comprehend.
