Nicholas Ninow concedes he knew what he was doing was wrong when he raped a 7-year-old girl in the toilet at the Dros restaurant in Silverton.

As his trial got under way in the North Gauteng Court on Monday afternoon, the 21-year old's legal representative read into court his guilty plea.


Ninow admitted that he had no justification for the rape, possession of illegal substances and defeating the ends of justice.

He did, however, plead not guilty to allegedly assaulting the mother of the girl and Dros employees on the scene.

In giving his account of the day in question, Ninow alleged he had been taking excessive amounts of the drug, CAT.


He said he was a patron at the restaurant but felt unwell and went to use more drugs in the bathroom as he was worried the restaurant manager would disturb him.

However, he said he then decided to use the female bathroom instead and get undressed to give the impression he was using the toilet and took off his shirt as he was burning up.

According to Ninow, the little girl - a stranger to him - walked into the stall and indicated she wanted to use the bathroom wherein he then impulsively grabbed her.


He then proceeded to rape her. [IOL has chosen not to include the graphic details of the rape, which was disclosed in court today].

“I knew what I was doing was wrong, I knew she was a minor and could not give consent and have no justification for my actions. The mother and others barged in and I attempted to run off.

“As I was trying to get away I realised I still had the little girl's panty and then proceeded to flush it to get rid of anything that would implicate me.”


State prosecutor Dorah Ngobeni said while she accepted the guilty plea on three counts, the State still intended to proceed with the trial.

The first witness to take the stand is an employee of the Silverton Dros franchise where the incident took place.

He pleads guilty, went into graphic detail of the rape and admits he tried to flush evidence. So normally there would no need to waste the courts time.

The state needs Ninow desperately with them not going after corruption cases getting attention. Usually in this case there is no need for witnesses and he has acknowledged everything.
The state is going to grandstand this and will act like he pleaded not guilty so have to call all the witnesses and look good in front of their supporters even though it is pointless. He admitted everything in detail already.

But the state says he hasn't adequately provided details of his crimes. Why is there a need for the state to call the waitress as if to ID him when he pleads guilty?

We need the f'r sentenced because he plead guilty. Not weeks of a trial with irrelevant details because the state want to look like a hero to black people as if he plead not guilty.

Our courts have such incredible backlogs. Where is the justice for all those victims of murder and rape. Our justice system is a joke.

The state is probably trying to counter the leniency for his guilty plea. They want to show that it was premeditated. Previous article I read said he followed the girl to the bathroom. In his explanation he makes it sound like he did it instinctively and the girl came to the bathroom after him.

Also he pleaded not guilty to assault. They probably want to have him found guilty of that too.
 
So many lives ruined, including his. Skip the trial throw away the keys!

Yes then call witnesses to show that. Don't call all witnesses and discuss irrelevant things.

not following the trial live. Did they say they will be calling all witnesses?

I'm guessing they will probably call a few witnesses who saw him follow the girl. Few witnesses who saw him assault the mother and staff member. Few witnesses to indicate the damage to the girl and impact on her life.

Or it could just be that the prosecutor wants to add this to her resume and improve her promotion prospects. Doubt it is anything to do with the NPA wanting to direct attention away from their failure to prosecute corruption which for the most part is the police's failure to properly investigate cases.

Why are you defending a rapist. The state needs to squeeze the judge for the longest possible jail term, why are you making it about race? There have been cases previously where people plead guilty, but the state proceeds with the trial because they do not believe the guy pleaded to all alleged offences, they want to prove additional criminal charges, maybe those that he did not admit to. Why are you so hell-bent on defending this monster?

Not sure who is worst, you or Nicholas... A lot of people, lot of people are sentenced to long jail terms weekly, why do you want this trial to be swept under the rug? The justice system is a joke? How many law degrees to you have?
 
For the sake of the victim, I think this should be over with as quickly as possible, with the harshest sentence and the least amount of necessary involvement from her or her family..

If you plead guilty you don't have a trial. It's pointless. How does it gets swept under the rug if you plead guilty?

This is the huge mistake you are making. You see it as whites on trial. You see it as a benefit to all black people. It should be a legal process. The legal process says you have a trial in you plead not guilty. He plead guilty. Will the little black girl benefit or her parents benefit by their being a trial when he plead guilty?

Oh, Boy! How many whites have been on trial for heinous crimes lately... A lot, so voetsek with your racist agenda. Justice isn't about meting out harsh sentences, it is about getting to the truth as told by victims and offenders alike. Victims and other witnesses deserve a shot at telling their story.
