To get bail he had to prove exceptional circumstances. The judge in the case said there was exceptional circumstance based on balance of probabilities meaning 50/50. She just takes at face value what his lawyer says that the ANC man has a chronic disease. No doctor report or anything. Yet the step son also gets bail.
Balance or probability means you are allowed to lie.

Problem is this is a guy with lots of cash facing life in prison (25 years). He is going to try bribe someone or influence someone. That is nature of someone so powerful. That is the reason these guys facing life have for child rape do not get bail and have to stay in prison if a 7 year old says her father raped her after being found by their teacher bleeding from her genitals. That kid has no reason to mutilate herself and lie at the same time. His defense never gave a reason who could be the real culprit. Just that he is the victim. This is his daughter who lives in his house. You see the kid daily and will pick up behavioral differences. You would know if something happened to them. Surely you should want to find out who raped your daughter if you are innocent. Yet he just claims he is innocent and doesn't care who raped his daughter.

In my view exceptional circumstances were not proven for him to be released.

Who raped the other twin. The son in law. Surely the son-in-law's life is in danger from the father. Any father would want to take justice in their own hands if a non blood relative rapes your daughter. Why was this fact not dealth with in this case? Why was the son in law given bail as well. Why was the judge not concerned about this?

Can someone explain that to me?

I know the family. That's Nicholas' father. My sister told me he was a fscking perv. Didn't know him well enough to judge but never did like the dude.

Not just the application of the law. But how they are treated by the public. No outrage.

Look at the video that was taken after the ex ANC MP was released on bail for raping his twin daughters.

He is treated as a hero.

To me that video is disturbing.

Compare that with how the political parties went berserk and marched because of the drug addict David Ninow. How they labelled all white people as rapists.
 
IF I understand correctly, from what @Convict posted. If you follow all the right channels you are allowed to be heard.

Can’t believe the sick f is given anything though, he didn’t kill the child. I do not know which is better for her.

Every convicted person can appeal, at least until your leave to appeal has been denied. So it is just normal route he is going to try and get his sentenced reduced, does not mean it will be successful.
 
Dros rapist Nicholas Ninow 'charged' for possession of cellphone in prison

Dros rapist Nicholas Ninow has been charged for possession of a cellphone in Baviaanspoort prison where he is serving a life sentence.

Ninow faces losing “some privileges”, however his conduct behind bars will not affect his appeal against his prison term.

Correctional Services spokesperson Singabakho Nxumalo said Ninow was found in possession of a cellphone during a search on Saturday.

“Such gadgets are classified as contraband and are not permitted inside correctional facilities. And this is a disturbing development as DCS is working to have contraband-free facilities.

“Offender Ninow has been charged in terms of section 23 (1) of the Correctional Services Act. He will be reprimanded accordingly, a process which may involve the withdrawal of privileges for a specific period, reclassification, in other words, a downgrade and other punitive measures.”

Is having a cellphone not a privilege already? That aside what about charging the person that allowed the cellphone?

You do get charged internally, if found guilty, which always is the case, you will be sent to isolation cells for a stipulated time. In my last prison I was in, that was 41 days isolation. You will also be moved down one classification group, so from A -> B or B-> C or C-> D. Only A group inmates are allowed contact visit for example and be allowed to have a kettle, radio, iron, maybe a tv depending on the prison.

The spokesperson is trying to sound like this is something very serious, and maybe it is, but they are not going to launch any investigation into this, when almost all inmates have phones that was smuggled in by a correctional officer, who is going to investigate it?

But yes he is going to go to isolation cells for a bit, no smoking, 23 hours a day locked up, nothing with you in the cell. That is worse case though and it also differs from prison to prison.
