Case against Dros rape accused postponed as bed still not available at Weskoppies

The man accused of raping a 7-year-old girl in the bathroom of a Dros restaurant in Pretoria was tearful in the dock of the Pretoria Magistrate's Court on Wednesday as he was told that a bed at Weskoppies Psychiatric Hospital was still not available.
As a result, he cannot be submitted to the institution for mental observation and the case was postponed to next year.
The accused, wearing a grey hoodie, could be seen sobbing and wiping tears from his eyes as he stood in the dock with his head down but still following the court proceedings.
Still waiting for a bed
State advocate Sanet Jacobson told the court on Wednesday that the accused was Number 14 on the waiting list for a bed and asked that the case be postponed to January 15, 2019.

Pretoria - Civil rights group #NotInMyName on Wednesday said it was disappointed with yet another postponement in the case against the man accused of raping a seven-year-old girl in a Dros restaurant in Silverton, east of Pretoria.
The matter was postponed to 15 January 2019, but could return to court earlier if a bed becomes available at Weskoppies Psychiatric Hospital in Pretoria West.
"He is trying to postpone the inevitable by requesting these mental evaluations," #NotInMyName secretary general Themba Masango outside the Pretoria Magistrate's Court.
He said that the suspect's use of bipolar disorder as an excuse for his behaviour was an insult to people who lived with the condition. "We will not rest until he goes to jail," Masango said.
"At every appearance, we will be there to insist that he goes to jail and for a very long time."

EXCLUSIVE: Substance found on Dros rape accused tested positive for cocaine

The substance found on the 20-year-old accused of raping a 7-year-old girl in the bathroom of a Dros restaurant in Pretoria has been identified as cocaine.
A reliable source told News24 that a forensic analysis of the substance revealed that it tested positive for cocaine and that the charge sheet has been completed to reflect that the accused was in alleged possession of cocaine.
Furthermore, police have also tracked down a man who socialised with the accused at a restaurant on the day of the alleged incident, and a statement was obtained from him.

His lawyer's job is to give him the best defense and that would be the defence that gives him the lightest sentence. If the police didn't get him to do blood test then the lawyer will definitvely claim he wasn't in control of his action because of cocaine in his system.

Worst case scenario has happened. This has already been turned into a racial issue by the EFF and ANC to distract people from their corruption. Malema is already calling the members of DA in parliament the name "David Ninow" which is unusual since he hasn't been put on trial yet. I am sure Malema knows David Ninow was on cocaine and according to South African law he would get a suspended sentence or light sentence in mental institution. This gives Malema the power to use the populist rhetoric and get the man on the street, not knowing case law has to be applied, to beleive because he is white for that reason he was treated preferentlally.

Courts do take remorse into account, or what they perceive as a lack of remorse.

This is what I was interested in from the the outset. Apparently the man was much older so I'd be keen to find out what the relationship is between these two and if there was some sort of grooming involved.

The ANC consists two parts. The Zuma and Ramaphosa faction. The Ramaphosa faction is allowing the Zuma faction to continue in the ANC since they are so powerful and Zuma is still pulling lots of strings so that is why Ramaphosa isn't getting rid of them to keep peace.

A tool the Zuma faction in the ANC use is this information organisation called BLF. The BLF supposed mandate is Black Land First but all they do is defend the Guptas and the Zumas. They are NOT a political party and don't stand for election but is purely used like Bell Pottinger was used to spread misinformation and remind Ramaphosa that the Zuma faction is still in control of the goverment.

I know this is a political thing. I am saying if his lawyer is going to use the drugs in system, not in control of senses defence to get him off or get a light sentence then it is really going to be spiral out politically. The case law where people got off due to drugs in their system is there and cases by law have to be treated the same as previous case law.

The ANC already highlighted the judge being white means he is biased. This should be irrelevant. What do you think the ANC will say if this white magistrate gets David Ninow to go free or gets a suspended sentence if he uses the cocaine in his system meant he wasn't in control of his senses. The case law is there. This is a valid concern.

I am sorry but this case is the Golden Goose for the ANC Zuma's faction and its BLF information voice.

If this was the reaction before the trial and before he even appeared in court imagine the hellstorm that is going to happen if the white magistrate applies case law and lets him off with a non jail sentence if his lawyer uses the drugs defense with regards to drugs being in his system causing him to not be in control of his senses and thus found innocent. For the country the cocaine positive test is a possible worst case scenario.

Drugs as a defense shouldn't fly, especially when there is a minor involved, and with so much physical evidence. He was in enough control of his senses to plead innocence and hide evidence. Also not wanting to wanting to hand over his phone is not going to help him either. He's dug himself a deep grave imo

If a case where you can prove you were not in control of your senses you can get off of murder. There is case law for that. If you have a good lawyer, money to get in experts, the psychologists find in your favour then it is possible you can not get a prison sentence.

The question is was he in control of his sense when he committed the rape? he can argue that the video taken of him where he denies raping the girl means that he regained his senses afterwards so couldn't remember. However he tried to hide evidence by flushing it down the toilet. This was a bad mistake on his part. if you are aware of a crime so you are covering it up that is a problem for the not in control of your senses defence.

A recent case comes to mind. Diego Novella murdered his girlfriend in Cape Town. He didn't deny the murder but said his mind was hijacked so it was in fact his mind that was on trial. He was found guilty because the judge found this defence to be false

Delivering his judgment, Judge Vincent Saldanha said: "In my view, the accused's version was wholly contrived. There is nothing in [his] conduct that his mind had been 'hijacked'."

Saldanha said he was satisfied that, at the time of the incident, Novella had the ability to distinguish between right and wrong.

"In my view, he knew exactly what he was doing at the time and it was a clear indication on his part of the intent to murder the deceased," he said.

You don't even need drugs, if you believe strongly enough in the thokoloshe that will help you when you hack a minor to death...

It isn't. You can't claim that you did something involuntarily because you voluntarily used a mind altering substance.

This is true, except in the very unusual situation of involuntary intoxication (e.g. your drink gets spiked at a club, in the altered state of mind induced by that drug you murder someone, you are not culpable and will be acquitted).

In the vast majority of other cases, substance use at and around the time of a criminal offense is seen as an aggravating factor.
