Worst case scenario for him is 5 years and he only has to serve one. He can't possibly get a worse sentence than Oscar. Irrespective how negligent and irresponsible he was, it was still an accident.If it is proven that the defendant was driving recklessly and/or drunk I hope they throw the book at him.
A detailed account of how the accident occurred haven't been published yet have they?
Without having proof e.g. a blood test the defendant will say whatever excuse will make him sound less negligent i.e. he lost control, swerved for a dog, can't recall so could have had a blackout. The point is no blood test was taken so he can't feel the full force of the law.^ Surely you don't go crashing through a red robot for no reason, so it could be he gets charged with culpable homicide?
Preshalin Naidoo‚ 22‚ faces charges of reckless or negligent driving and culpable homicide. His trial in the Randburg Magistrate’s Court‚ Johannesburg‚ was to have started on Thursday‚ but Naidoo’s attorney and advocate both withdrew as his legal representatives on the day and the court gave him a day to get other representation.
Magistrate Ndivhiwo Setusha refused a postponement request by the defence‚ saying that the case had been postponed numerous times.
Attorney Satch Govender told the court he was withdrawing because of a “breach of trust” between him and Naidoo and advocate Francois Roets asked to be excused because he had not yet been briefed on the merits of the case and could not proceed.
JOHANNESBURG - A man implicated in the death of Top Billing television presenter Simba Mhere has told the Randburg Magistrates Court a mechanical fault was the cause of the crash.
Preshalin Naidoo is facing two culpable homicide charges for the crash on William Nicol Drive in January, in which Mhere and his friend Kady-Shay O'bryan were killed.
Naidoo’s statement, listing the mechanical fault, was read out in court earlier today as the trial finally got underway almost a year after the incident.
Naidoo claims he lost control of his vehicle due to a suspension problem.

Johannesburg - After months of delays, Simba Mhere’s father finally took the stand on Tuesday as a witness to his son’s death.
A presenter for Top Billing, Mhere, along with his friend Kady Shay O’Brien, died in late January, the victims of a horrific car crash. The driver of the car that caused the accident, 24-year-old Preshalin Naidoo, was charged with two counts of culpable homicide, but the case stalled in court postponements from July until now.
“I looked to my right where my son was seated. He was motionless. I looked back where his friend was seated. She was motionless,” Mhere’s father Joseph sombrely told the court.
He was the first witness called by prosecuting team Matthys De Jager and Dinesh Nandkissor.
Wearing a blue jacket and pausing each time he said the word ‘son’, Joseph recounted how Naidoo lost control of his white VW Polo and slammed into the driver’s side of Mhere’s Mitsubishi Mirage hatchback.
“I don’t remember how many times the car rolled,” Joseph said, as he gestured with his arms to show the tumbling motion of the car. He recalled the paramedic who arrived and told him not to move because he had back pain. He said the paramedic then went to the driver’s side of the car to check his son and O’Brien.
This defense can blow up in his face quite easily. Vehicle wasn't maintained properly, customised the vehicle that impact the integrity of the suspension are Intereting angles for the prosecution. If this doesn't work, he is in effect blaming the car manufacturer for a faulty car. They have money and good attorneys, so that will be refuted

Yes, and drivers sit on the right in SA cars, so a passenger in the front passenger seat would need to look right to look at the driver.
