Tracker evidence allowed in Simba Mhere murder case

Johannesburg - The magistrate in the trial of Preshalin Naidoo, who was involved in a car accident in which Top Billing presenter Simba Mhere was killed, on Tuesday ruled in favour of the State to produce evidence from a car tracking device.

On Monday, the State had made an application in the Randburg Magistrate’s Court, to introduce new evidence from the tracking device that was in Naidoo’s vehicle, as well as from his insurance company.

Naidoo‚ 24, faces two charges of culpable homicide relating to the car crash in which Mhere and his passenger Kady-Shay O’Bryan died. The crash, which involved three cars, occurred along William Nicol Drive in Fourways‚ Johannesburg, on January 31‚ 2015.

Advocate François Roets, for the defence, had argued against the introduction of the evidence.

Magistrate David Mahango said that the question was whether allowing the State to produce the evidence would amount to a fair trial.

He added that there would not be any prejudice suffered by Naidoo by allowing the State to produce the evidence.

Simba Mhere case postponed as defence objects to State witness

Johannesburg - The case against a man accused of causing an accident which claimed the life of Top Billing presenter Simba Mhere and his friend was postponed by the Randburg Magistrate’s Court on Thursday.

Lawyers for the accused, Preshalin Naidoo, objected to the State’s request to introduce new evidence which a new witness would present. The witness was expected to present data from a GPS tracking company.

Francois Roets, for Naidoo, told the court he could not allow the evidence to be admitted without checking whether it was admissible and reliable.

He suggested that the Electronic Communications and Transactions Act be applied. The act required a certified officer to verify information.

Roets challenged the State to tell the court about the nature of the evidence.

“We are still left out in the cold on the admissibility and the nature of the evidence.”

Prosecutor Dinesh Nandkissor told the court the decision to introduce the evidence was taken on Monday, and that the defence was furnished with a report the following day.

Nandkissor told the court the defence had had enough time to raise concerns about the report, but only indicated an intention to object on Thursday morning.

He asked that the court hears the evidence and decide for itself whether it would deem it reliable or not.

Trial to proceed in October

Nandkissor cautioned the court against further delays. Roets proposed that due to the nature of the evidence, both teams should prepare heads of argument on the matter.

Magistrate David Mahango granted the defence permission to prepare heads of argument for 14 October. The trial would then proceed from 24 to 28 October.

Naidoo faces two counts of culpable homicide for the death of Mhere and his friend Kady-Shay O'Bryan, and additional charges of negligent and/or reckless driving, and inconsiderate driving.

Mhere, 26, and O'Bryan, 29, were killed in the collision on William Nicol Drive, in Fourways, on 31 January 2015.

Mhere's father Joseph was travelling with the two. He survived.

Mhere rose to fame when he won a presenter search competition in 2010, landing him a job on the lifestyle television programme.

Simba Mhere case to be heard in 2 weeks

Johannesburg - The trial of the man who allegedly caused the accident which killed Top Billing presenter Simba Mhere and his friend Kady-Shay O'Bryan will continue later in October.

Preshalin Naidoo is expected to appear in the Randburg Magistrate’s Court on October 24 for the continuation of his trial.

Naidoo faces two counts of culpable homicide, as a result of the crash on William Nicol Drive, Fourways, in the early hours of January 31 2015.

Mhere's father Joseph survived the crash. O'Bryan had a 3-year-old daughter.

In previous testimony, a witness, Mamokete Laka, said she was coming home from a church service with her mother and brother when they saw the crash in front of them.

She said Naidoo kept apologising and said he had fallen asleep. She said he smelt as though he had been drinking alcohol, but she did not mention this to police at the time.

Simba Mhere case postponed

Johannesburg - The trial of the man accused of killing Top Billing presenter Simba Mhere and his friend Kady-Shay O'Bryan was postponed in the Randburg Magistrate’s Court on Monday.

Preshalin Naidoo’s lawyer, Luando Voster, asked for a postponement, as his colleague advocate Francois Roets had a stomach bug and would only be available on Tuesday.

Roets is the advocate in charge of Naidoo's defense.

Prosecutor Dinesh Nandkissor said he expected to conclude the State’s case against Naidoo on Friday.

During his brief appearance, Naidoo sat silently in the dock. He was dressed in a beige suit jacket and navy pants.

Naidoo faces two counts of culpable homicide and additional charges of reckless or negligent driving, and inconsiderate driving. His VW Polo GTI crashed into Mhere’s car on William Nicol Drive, Fourways, in the early hours of January 31, 2015.

Mhere's father Joseph was a passenger in the car. He survived. O'Bryan had a three-year-old daughter.

Mhere crash accused was travelling at 166km/h

Johannesburg - Evidence in the Randburg Magstrate’s Court on Tuesday, showed that motorist Preshalin Naidoo who was involved in a car accident where Top Billing presenter Simba Mhere and his passenger Kady-Shay O’Bryan were killed, was travelling at 166 kilometres when the accident occurred.

“At 05.36am Naidoo off-ramped at William Nicol Drive and was travelling on the far right hand lane at 166km heading towards Monte Casino,” Car Track Fleet Manager Lorenz Stoger told the court.

Naidoo‚ 24, who faces two charges of culpable homicide relating to the car crash in which Mhere and O’Bryan died, which involved three cars, occurred along William Nicol Drive in Fourways‚ Johannesburg, on January 31‚ 2015.

Prosecutor Dinesh Nandkissor began questioning Stoger who earlier told the court that he had been a witness for court related issues before and had worked with tracking devices for a number of years.

Nandkissor asked Stoger why there was no indication of breaking on the data sheet at that moment.

“Breaks were not applied harshly,” Stoger responded.

Stoger said that the speed of Naidoo’s vehicle was recorded at 166km/h and suddenly went to 0km/h because of the impact with the other vehicles.

Earlier, Stoger described the device that was installed into Naidoo’s vehicle in order for this data to be retrieved.

Who the f falls asleep at 166km in a 80km zone. If you are driving that speed through many intersections and your not on the highway you need full concentration.

Personally I think insurance companies who use tracking should be allowed to refuse cover where compelling evidence suggest the driver is not obeying any laws.. I mean its easy to spot cars going down the wrong side of road, excessive speeding and going thru stop signs. Maybe after picking up on reckless behviour mark the guy as a risk such that he is unable to get insurance(life or vehicle) anywhere.
 
That's negligence of note, surprised people even survived at that speed, accident scene must have been horrific.

Guy was probably smashed and dog tired, in that state it's easy to slip in and out of sleep whilst at the wheel, granted the guy may just be claiming that in a bid for leniency.

They should just make trackers mandatory and then a requirement for every case involving a car.

We would all drive like angels.

How do you fall asleep at almost 170 ? I can only imagine he fell asleep with his foot on the pedal.
