and then everyone should be forced to have (third party) insurance. Like in America.

If you get caught without insurance you can lose your license.

The tracker showed he was already going that speed when he turned off the highway. If he was turning and reacting to traffic then he must have been sleep driving where he is still aware of his surroundings but not liable as he is not aware he is driving as he is sleeping.

Exactly.. while insurance companies can't enforce laws in SA, much like most citizens can't .. they should force law and order indirectly this way.

SA is at the point where either law & order needs to return or insurance will be pointless as everyone does as they please anyway. To me it seems like lawlessness is the way it goes as people prefer 'freedom' over being lawful.

Self-driving cars will all have trackers. I don't expect cars after like 2020 not to have them.
 
Simba Mhere culpable homicide case postponed

Johannesburg - The trial of the man accused of killing Top Billing presenter Simba Mhere and his friend Kady-Shay O'Bryan in a road crash was postponed in the Randburg Magistrate's Court on Monday.

Preshalin Naidoo's lawyer Francois Roets asked for a postponement for the defence to consult with experts to prepare for the cross-examination of a witness.

This after a witness, Lorenz Stoger, from CarTrack, testified on Monday morning.

Naidoo sat silently in the dock during his appearance.

He faces two counts of culpable homicide and additional charges of reckless or negligent driving and inconsiderate driving.

His VW Polo GTI crashed into Mhere's car on William Nicol Drive, Fourways, in the early hours of January 31, 2015.

Mhere's father Joseph was a passenger in the car. He survived.

The matter was postponed to February 7, 8, and 9 2017.

Looks like Naidoo has deep pockets for lawyers, wouldn't be surprised if he gets off with a slap on the wrist.

The Randburg Magistrate’s Court has dismissed an application for a discharge by Preshalin Naidoo‚ the man accused of causing the death of Top Billing presenter Simba Mhere.

Naidoo faces charges of culpable homicide and reckless and negligent driving following the death of Mhere and his friend‚ Kady-Shay O’Bryan‚ who was a passenger in the car Mhere was driving.

The pair died at the scene of the accident on William Nicol Drive in Fourways‚ on January 31‚ 2015.

Preshalin’s lawyer Advocate Francois Roets on Tuesday brought an application for a discharge in terms of Section 174 of the Criminal Procedure Act.

Expert testimony delays Simba Mhere case

Johannesburg - The man accused of killing Top Billing presenter Simba Mhere and his friend Kady-Shay O'Bryan in a car crash appeared briefly at the Randburg Magistrate's Court on Wednesday.

Preshalin Naidoo faces two counts of culpable homicide and additional charges of reckless or negligent driving and inconsiderate driving.

He appeared in court dressed in a fitted grey designer suit, accompanied a group of people presumed to be his family and friends.

The court heard that experts who were due to testify on Wednesday would only arrive in Johannesburg on Thursday.

The matter was postponed to February 9. On Tuesday, the court rejected Naidoo's lawyer's application to dismiss the charges.

Simba Mhere trial: defence questions cop's version

Johannesburg – The defence in the trial against Preshalin Naidoo in the Randburg Magistrate's Court on Thursday questioned police work done at the crime scene by a Johannesburg metro police officer.

Naidoo, 24, is currently on trial for allegedly causing the fatal 2015 car accident that claimed the lives of Top Billing presenter Simba Mhere and his friend Kady-Shay O'Bryan.

He faces two charges of culpable homicide.

The crash involved three cars and happened on William Nicol Drive in Fourways, Johannesburg on January 31, 2015.

Defence advocate François Roets called IBF Investigations South Africa's chief reconstruction specialist, Stanley Bezuidenhout, who had compiled a report on the accident.

Bezuidenhout told the court that he had been part of the South African Navy and military where he was trained in intelligence and investigations and later moved onto tyre analysis as well as post collision investigations.

He said that he was approached in October 2015 to assist with investigating the incident and compiling a report of his findings.

Johannesburg – The defence in the trial against Preshalin Naidoo in the Randburg Magistrate’s Court on Thursday argued that a mechanical failure caused the accident which claimed the lives of two people.

Naidoo, 24, is currently on trial for allegedly causing the fatal 2015 car accident that killed Top Billing presenter Simba Mhere and his friend Kady-Shay O’Bryan.

He faces two charges of culpable homicide. The crash involved three cars and happened on William Nicol Drive in Fourways, Johannesburg on January 31, 2015.

Defence witness IBF Investigations South Africa Chief Reconstruction expert, Stanley Bezuidenhout, showed an image which he told the court demonstrated that Naidoo's vehicle was in an abnormal state when the accident occurred.

"The steering components were examined and were clear but there was a mechanical failure in the front right suspension," he said.

Bezuidenhout displayed an image that showed that there was a nut missing on the vehicle which could have caused a mechanical failure in the steering wheel.

He went on to show that there were bolts that were loose in the CV joint of Naidoo's vehicle and told the court that he could unscrew it with his hand when he examined the vehicle, which should not happen in a vehicle in good condition.

Bezuidenhout later showed pictures of the scene and said he didn't believe that the scene was contaminated.

I really they hope don't waste all this money prosecuting this guy only to convict and give him a suspended sentence or a fine with no jail time.
 
That morning we finished a server move and accident happened around 5am (a Saturday) - I went past there shortly after it happened (stopped at the BP before the bridge to pick up Red Bull) - and the story was that some guy fell asleep and skipped a light. The whole bridge-section looked like a complete mess. I just thought "thank god I stopped at the BP - this could have been me".

I don't think anyone can reliably call the cause of accident a mechanical failure - the cars involved looked pretty banged up and it certainly looked like everyone was speeding.

That's what the paid for "experts" are there to do, find faults and state in their "expert" opinion they caused the accident hence guilty guy gets off scott free, in our screwed justice system with no state experts to repudiate these claims you are almost home free.

Have they focused on the state of the driver at the time of the collision? Looks like the defense is doing a refocus job, car loose bolt case closed, not the full picture which is car with potential loose bolt + drunk speeding driver.
 
Defence witness refuses to concede alcohol may have caused Simba Mhere smash

An accident reconstruction expert would not be drawn into conceding that alcohol could have been a contributing factor in an accident that caused the death of Top Billing presenter Simba Mhere's death.

Stanley Bezuidenhout compiled a report for the defence in which he concluded that the car driven by Preshalin Naidoo‚ the man accused of causing Mhere and his passenger's death‚ had a mechanical failure

Preshalin Naidoo is facing charges of culpable homicide and reckless and negligent driving for the pair's deaths. He has pleaded not guilty to the charges.

Bezuidenhout's report found that a missing bolt in one of the tyres was the main cause of the accident.

On Tuesday‚ Prosecutor Dinesh Nandkissor asked Bezuidenhout if alcohol could not have been the cause of the accident.
