Traffic violation

Hey guys,

So yesterday I was driving home from Potch, I was flashing my headlights warning the inbound motorists of speed trapping up ahead. Big mistake.

Long story short, I got a R2500 fine for "Obstruction or hindering a peace officer of his duty". Though online I see the fine should be R500 - http://www.aarto.gov.za/downloads/027_AARTO Chargebook July 2008.pdf

How do I proceed? I don't want to freaking pay R2500 for this, I admit to being in the wrong but I don't think I was R2500 wrong.

Also, I can't go to Potch to contest this in court.

There was another cop ahead, being very sneaky.

I don't see how this would stand up in court. It's almost impossible to prove that you were flashing your lights just to warn motorists of the speed trap. There are a thousand other reasons why you could have been flashing your lights. You should go to court and challenge this, especially if it's just your word against a lying thieving metro cop.

From very recent past experience contacting the prosecutor is the way to go (I got a huge reduction - not for the same violation though).

Just say you went over a speed hump, or a few potholes. This causes the low beam to shine upwards for a fraction of a second.

That's a rough deal.

If I were you, I'd just tell them I was actually flashing at the dumbass that just cut in right in front of me without warning. They would have to prove otherwise.

Yip, don't admit to anything.
They have to prove you intended to warn the people. There are a million reasons you could be flashing your lights.

The fine would be an admission of guilt. So dont admit guilt and dont pay. Arrive at court and they will throw it out.

OP if you didn't persuade your way out of it on the spot and signed it you've admitted guilt already. Only "solution" would be to go through the process of reducing it a bit because that is quite steep.

It's only a lie if you can prove it's a lie.

You can't admit guilt on the side of the road. Payment of the fine is admitting guilt, not accepting the fine on the side of the road.
