Two die in Mtubatuba N2 accident
The accident occurred just before lunchtime on the N2 at Kwiliza, near Mtubatuba

TWO people lost their lives earlier today (Tuesday) when the car in which they were travelling hit a truck head-on.

The accident occurred just before lunchtime on the N2 at Kwiliza, near Mtubatuba.

According to police reports, a Toyota Rav 4 was travelling northbound behind a VW Polo when the driver of the Polo pulled out into oncoming traffic and collided with the truck travelling south.

The VW Polo engine was reportedly flung into the windscreen of the Toyota Rav 4

The Polo’s engine was reportedly ripped out of the engine compartment and smashed into the Rav’s windscreen.

One of the Polo’s four occupants was flung from the vehicle over the barrier.

The Polo driver was declared dead on the scene, while the other male occupant was rushed to hospital where he was later declared deceased.

The truck was travelling south when the VW Polo, travelling north, hit it head-on

Two female occupants of the Polo were rushed to hospital in a serious condition.

The three Rav 4 occupants have also all been hospitalised with serious injuries.

Mtubatuba SAPS have opened a case of culpable homicide.

Wondering who would pay for the Rav4 and Polo passengers' injuries without a RAF as some suggest since the culprit is dead and his insurance would probably not cover it.

There would be 5 more crippled beggars in the streets.

well if he was insured the company would still have to pay. Why do you think otherwise just because he is dead. Also raf covers everybody.

If he was driving against the traffic, the insurance probably wouldn’t cover... Or they would find a fault in the tires, brake pads or any other legality to not cover.

I know the RAF covers everybody, I ask the question for the proponents of the RAF’s suppression.
 
I still wanna see stats wrt kzn road deaths as it shoots up over holiday season. I would love to see a breakdown of vehicle registrations involved in accidents. I'm willing to bet money it's due to gp plate cars based on schite i've witnessed over the years..

Have you ever driven in Limpopo? You might want to revise your statement after doing so.

He was negligent, insurance will pay out. What's the point of insurance then if they don't pay out when a person is at fault, one party is usually at fault in a vehicle accident.

Limpopo is a schitehole (same as eastern cape, lesotho, swaziland and rural kzn) but I fail to see your point

They might dismiss the vehicle owner at faults claim but they're not gonna get a free pass on claims from victims involved in the accident, not gonna happen.

You will have to narrowly define reckless driving, the polo owner might have though it was safe to overtake, how do you disprove that?

In 1998 I wrote two cars off, mine and the guy I t-boned running a red light (was early in the morning and the rising sun shone directly behind me making the light look green to me), I was clearly at fault in a legal sense. There was no hesitation from my insurance to settle both my claim and the party I wronged.
 
Nice stretch of road but driving is atrocious.

Nope. Not entirely true. Not all policies contain exclusions which void the claim of the driver who is at fault. Countless claims are paid where a driver jumps a red light or fails to stop at a stop sign or exceeds the speed limit. Insurance companies walk a very narrow and dangerous path if they cite disobedience of law to reject a claim.

The short term insurance ombudsman takes a particularly dim view of companies who use law to wiggle out of claims. Even if there is circumstantial evidence that a driver had been consuming alcohol shortly before a collision (which all policies will reject the claim), evidence needs to be fairly solid for a successful rejection.

Concerning the RAF, I don’t think that there is a no fault basis in current legislation. It’s certainly coming in RABS, which going to be extremely contentious. RAF prohibits any from pursuing the negligent driver and all can only claim against the Fund. Even then compensation will be limited. For most South Africans compensation by the Fund will probably be sufficient. For the rest who earn more than the current ~250K p/a, you should have sufficient compensation from a combination of Personal Accident and Life Insurance.
