Unfair Working Conditions

Hi all,

Could anyone assist in regards to unfair working conditions. My girlfriend currently has two half day jobs until the completion of her degree. The one keeps her busy until 11am and the second one starts around 11:30am.

Her second job asked her to be at work at 10:30am this morning, which obviously she couldn't make. I told her to inform them she will be there normal time. They responded that it will be seen as one day unpaid leave!
There is no working contract, they don't work on one. They don't pay UIF at all and now this.

What to do? :(
 
Are the employers aware she works 2 jobs? I wouldn't call it unfair if they don't know.

IMHO with her 2nd job only starting at 11:30am, doesn't matter where she is, they can't deduct a full day's pay for not coming in earlier, she is still planning to be there on time.

Since it's going to be one day unpaid leave then she might as well not go at all.
 
Problem is that she has no Contract to fall back on.
If her usual starting time is 11.30am, they can not unreasonably ask her to come in early.
The only way they can do this is if it is for operational reasons and they gave her notice.
They will not allow to deduct a Days Leave if she arrives at work at her usual starting time
I think it is very important for your GF to get a contract as its Against the LRA to be employed without one.
 
This is fairly common. With jobs scarce and employers the king abuse like this is fairly widespread, especially for jobs that do not require a degree. Its more surprising for higher qualified people though. Personally if I was not desperate for the work I would politely but firmly tell them that its unacceptable for them to make such a statement. Also I would not work for someone without an employment contract. Places that do not have employment contracts are almost always the same places that abuse their staff.

Either way it sounds like the bosses are not the kind of people who care for their staff so I would seriously be looking for other work if I where her.
 
With no contract you hardly have a leg to stand on. They paying, so if you dont abide by their rules, they just not going to pay you.

Be reasonable about it, she should tell the second employee why she cant start at 10h30.

Getting some contract might be worthwhile.
 
Then take the day off. If they see it as one day unpaid leave then so be it :)
 
Title made me think this was about drilling rock underground in the dust and dark in 55°C heat
 
Does she need the money from the second job? or could she replace the second job with another?

If they're claiming her being an hour late for the revised starting time is equal to a days unpaid leave, then she should just leave the job altogether.
 
You don't need a contract. If they've been paying you, then you can show the employment relationship exists and relevant laws apply.

They paying, so if you dont abide by their rules, they just not going to pay you.
Fortunately the days where they can get away with that sort of nonsense are in the past.
