The federal judge assigned to the criminal case against Trump's former National Security Adviser Michael Flynn has ordered Special Counsel Robert Mueller to turn over any "exculpatory evidence" to Flynn's defense team.

Oddly, however, Flynn's legal team did not make this request. Instead, Judge Emmet G. Sullivan issued the order "sua sponte," or at his discretion, invoking the "Brady Rule" - which requires prosecutors to turn over previously unfiled evidence that might have a material impact on a defendant's case. Interestingly, two days before the order Mueller filed a motion for an agreed-upon protective order regarding the use of evidence in the case, including "sensitive materials," provided to Flynn's lawyers by the office of the Special Counsel.

As The Hill notes, Sullivan dinged federal prosecutors in the trial of former Sen. Ted Stevens (R-AK) for misconduct in failing to turn over exculpatory evidence.

The development has generated a significant buzz in conservative circles, with the implication being that perhaps Flynn might not have pleaded guilty in light of certain evidence.

Judge Andrew Napolitano addressed Sullivan's decision on Tuesday, saying The judge on his own, not in response to any application from General Flynns lawyers says, "By the way, I want all exculpatory evidence, evidence that could help Flynn or hurt the government turned over to Flynns lawyers."

Why would he we want that after General Flynn has already pleaded guilty? That is unheard of. He must suspect a defect in the guilty plea. Meaning, he must have reason to believe that General Flynn pleaded guilty for some reason other than guilt.

Adding to the odd turn of events in the Flynn matter is a February 1 report that Special Counsel Robert Mueller's team has postponed Flynn's sentencing due to the "status" of the investigation.

Some have speculated that Mueller's request indicates Flynn is cooperating with his investigation. Others, such as former federal prosecutor Joe diGenova, think that "It may very well be that the guilty plea cannot stand" after D.C. Judge Rudolph Contreras - who also sits on the FISA court and may have personally signed off on surveillance warrant(s) which ultimately included Flynn- recused himself days after he was assigned Flynn's case.

Defendants request—and prosecutors must supply—this sort of evidence in all cases. An IG report has been prepared that *may* produce evidence previously unknown to and undiscovered by Flynn—so the judge ordered the evidence produced. Withdrawing a guilty plea is *extremely* hard.

2/ In other words, no: nothing here raises questions about Flynn's guilty plea. The judge is noting that a prosecutor's obligation to provide Brady material extends beyond the date of plea if there is new Brady material known to the prosecution.

Flynn isn't withdrawing his plea.

3/ In theory, post-plea Brady material *could* lead a defendant to try to withdraw a plea, but a) the "new" Brady material here isn't *factually* exculpatory and only tangentially relevant, b) only in an *infinitesimal* percentage of cases does a defendant try to withdraw a plea.

The earlier version of the order directed the production of all 'favorable and material' evidence, including in plea cases. The revised version was more nuanced: the government must produce "during plea negotiations, *any exculpatory evidence* in the government’s possession."

Basically: Judge Sullivan's standing order requires the gov't to produce evidence that tends to show the defendant's innocence in all cases, including cases heading towards a plea. But in plea cases, as opposed to trials, the gov't may not have to hand over impeachment evidence.

Anyway, on November 20, 2017, Judge Sullivan went and entered this new version of the standing Brady order in all of his cases. (These cases also all already had the prior version of the Brady order entered on the docket when the cases were originally filed.)

Then a couple weeks later, the Flynn and Mueller reach a plea deal and the case is filed. Shortly after that, the judge originally assigned to the case was recused. Judge Sullivan was randomly reassigned, and first thing he did was to enter his standing Brady order, as usual.

So, fast-forward a couple months to last Friday, and someone now realizes that the wrong order got entered on the Flynn docket, and that they need to file the updated version.

No big deal, normally. It would be not be any kind of deal at all in pretty much any other case.

But this isn't any other case. So to avoid having something so incredibly minor get blown out of all proportion, Judge Sullivan's new filling included a quick docket entry to explain why the filing was made, and why it didn't reflect anything in particular about Flynn's case.

Tell me, if a judge was actually attempting to smoke out some dodgy dealings without giving the game away, would he not place a nice explanatory note saying how this particular change was just routine when it was actually anything but?

Since you're quoting Cernovich et. al. have you looked into what he said has happened with the Flynn case? I mean, he's a sleazeball and all, but unfortunately he's a sleazeball with good sources so you can't discount him completely. Do you think he's BSing?

New sealed criminal charges have been filed in federal court in the criminal case brought by special counsel Robert Mueller against Donald Trump’s former senior campaign aides Paul Manafort and Rick Gates, a court record seen by Reuters on Wednesday showed.

The single page, filed at the US district court for the District of Columbia, does not shed light on the nature of the new charges. He was then detained Sunday by police who accused him and a friend of making a false report about a bomb near his village outside St. Petersburg, he told The Moscow Times.
