He won't be convicted of 1st degree for which he is currently being held. They would reasonably be able to argue that the mace blinded him and he accidentally hit him in the head.

The excessive force part is clear though.

One would have expected him to fire more shots if he couldn't see what he was shooting...

Do you see any sign that he is a security guard? No? So that argument means nothing as the victim had no way of knowing.

The guy is trained private security
Had gun drawn before being sprayed
Aimed for the head
There was no grabbing of his gun.

So yeah you're correct it is indeed quite different from the Kyle Rittenhouse situation.
This seems like a straight forward case of self defense.

Why would any sane person attack someone who has a gun with pepper spray.

There's nothing like excessive force. Nothing say that because the protester attacked him with pepper spray that he is only allowed to defend himself with pepper spray back.

Only one problem. A journalist claims the security guard initiated the confrontation by trying to grab the mace, which led to the slap and the backing away. So the guy with the mace tried to protect himself.

Oh and the shooter is apparently not licensed to carry a firearm in Denver and Pinkerton denies that he works for them.
