Vodacom versus Gogga

ok the court ruled in Vodacoms favor on the 27 August and dismissed the interdict bought in by Gogga on the 9 July and the competition tribunal had struck the case from the role on the 8th July. Facts of the case:

Gogga had purchased data at 19c per MB prior to Dec 2007. In 2007 Gogga had signed a agreement for the new wholesale rate of R0.50c they never paid the R1.36. Gogga continued to operate for a further 2 years at the new rate...then the credit crunch hits and their customers could not pay their bills and defaulted. Gogga lost a big chunk of their subscriber base and therefor could no longer pay their bills. Vodacom had in the meantime reduced the rates to Gogga to 39c per MB...but Gogga could still not pay their bills. its a simple case of Gogga not being able to pay for their bills. In addition nothing precluded Gogga from finding another supplier of the data and no exclusivity with Vodacom existed. Read the court papers and competition submissions and get the facts!

Thanks for the clarification - pretty much what I assumed when this "scandal" surfaced a few weeks back.
 
Why am I not surprised... although the only side of the story I saw was on Carte Blanche.
