Vodacom warned about catastrophic R10-billion miscalculation

I thought this was obvious, in the other thread someone made a point that sounded good that says the opposite so really interested how this will play out.
 
Vodacom, if you don't want to listen you must feel the pain. Seems Vodacom was barking up the wrong tree all the time. Poor legal advice.
 
It's ok guys.

Vodacom is the first to trial losing 10 billion in a case. And like all the other articles about this scummy company the last few months, nothing will come from it.
 
They always do it their wrong way.......

It's not so clear cut. Just because there's intellectual property rights doesn't mean he has no claim. Patents is SA are not examined for validity so that only happens once it gets challenged in court. They would have brought that up in court if Vodacom had raised the patent card. The fact Vodacom didn't and MTN never enforced their patent against Vodacom is probably because both companies know it amounts to nothing. Secondly a patent would not override a contract but rather the other way around. Khan is spouting his opinion as fact again. He's holds the patent so has a conflict of interest.

Patent law is very clear cut in South Africa my friend.

IMHO... Vodacom didn't raise the existing patent because by doing so they would be acknowledging and thereby giving legitimacy to it. It would be foolish as they would be opening the door to an almost indefensible motion by the patent holder.
 
So let me get this clear: Vodacom didn't want to go the patent route because it would open them up to future action by MTN? Is that why MTN's lawyer is so vocal on this matter?

Yup, MTN (or more specifically Kahn) could sue them if they acknowledged it in court.
