What is it with McBride?

The justice system is not undermined either. The fact that it's being argued in a higher court tells us the legal system is functional albeit slow.

I disagree - but we will see what happens in the CC.

Of course, what is of interest is the other parties (relatives of Apartheid victims) who have joined in the case against McBride, for other reasons, but so be it.

Changing a piece of paper does not change history, are you guys unable to understand this ?

And I do think that it undermines the SA Judicial and Legal system.

For the umpteenth time: To pardon someone does not mean the crime was not committed. It means the person gets pardoned for doing so.

The Citizen claimed in an editorial that McBride, as a convicted criminal and murderer was therefore unfir to hold position in public office.

Seeing as McBride was pardonned for his crimes, he is not a convicted criminal or murderer by the normal definition of 'criminal' or 'murderer'. So The Citizen was being thrifty with the facts. If they wanted to continue arguing the point, they should have mentioned the controversial manner in which McBride gained amnesty for his deeds or detailed the other numerous indiscretions McBride has been involved in since being pardonned.

The SCA stated that it had no doubt that the intention was not only that people
to whom amnesty had been granted should not be held criminally and civilly liable for
offences committed by them in the course of the conflicts of the past and with the political
object of liberation, but also that they should be considered not to have committed the
offences and that those offences should not be held against them, so that they could be
reintegrated into society. The intention was to close the book on human rights
transgressions of the past in order to achieve reconciliation. Without an agreement on that
basis a negotiated settlement may well not have been possible.

McBride is a shady enough character even without bringing up his actions as a freedom fighter/terrorist. The Citizen should pick its battles more wisely in future.

No it'as just another one of Alan's fantasies that if you disagree with him, or "appear" to be more liberal minded than he can stomach, you must be ANC...:rolleyes:
