When thugs run the country

Jeez... I'm guessing the resident took a swing with the best weapon to hand. It's just a household object. Honestly, this government really is obsessed with turning it's population into unresisting victims.

I find it very amusing when people add their own social commentary to ambiguous stories. There's probably more to this story than meets the eye, Leitmotif, wasn't it you who said that police often look the other way in regards to charging the home owner in cases self-defence? Or does that only apply to when a gun is used?

... thats why, in this country, if someone breaks into your house, you kill them quietly, ad burry them in the back yard.

Actually there is nothing unusual about him been charged with murder, whenever anybody kills another person a case of murder is automatically opened and when it is shown that the person was justified in killing the other person, the charge is changed to justifiable homicide and the case is dropped.

As for him been arrested, he will be released, while the police investigate the charge

Standard Operating Procedure

Depends on the station and the individual police officers involved

Was he detained at the station or was he arrested and released?

They just say arreseted. As far as I know, its up to the cops descretion wether to arrest you or not...

I think an investigation is always a good idea - for all we know this 'robber' could have been a Good Samaritan trying to stop the guy from beating his wife.

There is much more than meets the eye, indeed... I just tend to take the side of a person defending their home. Yes, there could have been a number of reasons. Still, from what we're looking at in the story, this is a case of harrassment of people defending themselves.

Not sure what you mean by cops looking the other way... but the thing is, it's inconsistent. Occasionally - very occasionally - you'll hear of a self-defense case where the defender wasn't charged. More often you'll hear of a clear-cut self-defense where a murder charge is opened.

I like guns, and I love to shoot. This doesn't mean I only support self-defense when guns are involved.

I have often observed first hand that there can be a big difference between what actually happened and what the newspaper says happened

Oh really so self defense which by the way is one reason the police officially give you a firearm when applied for, is not even recognised by the same gvt dept? That is rubbish. A person does not have to be arrested in this case as it was self defense.

marine1 : They do need to investigate, and as R/SGT said, if it turns out it was self-defence, the charge is altered to justifiable homicide.

Its standard practice across the globe.

No he should not be arrested. He should be released on a warning and this does not warrant actual arrest. Self Defense can be seen at any scene. If the suspect was armed, bullet holes, shells etc. Problem is that the detectives in this country have no idea what they are doing. This comes from experience.

Nope a formal investigating docket is opened in normal society and if cause for concern is detected then it is referred to the director general for a decision whether to prosecute the "victim" or the "defender" of the property, hell who is the victim here? Once a murder docket is opened then that means the "defender" is alleged to have committed murder and is open to all kind of interpretations by whoever the judge is for the day and depending what nationality and group the "defender" belongs to. IMHO this is also wrong as murder is normally define as a pre-planned action with the intent to take the life of the person. Hell even the so called "botched up robberies" where farmers is killed is not murder in the eyes of this freak government. They class it different to skew the stats. Manslaughter is the correct alternative but to describe that to the police will be like trying to determine the sex of a snail. It was recently reported that the head of police do not even know the laws.

Correct, Murder has to have intent to kill. How can someone be charged with murder if he shoots someone who broke into his house ? He never intended to kill the house breaker or robber. What a load of crap. And to think some people here defend these criminals.

No, he is arrested, and then released whilst the investigation is on-going. Its standard operating procedure.

I don't see why this is a huge issue, because its normal. Its not like this is the first person to be arrested in this kind of situation.

So if it was standard procedure for cops to come round and charge anyone who spoke against the president, it'd be fine too? After all, no reason to worry if it happens all the time.

No, its a completely different situation, and you know that. When people talk out against the president there isn't a body left lying on the floor (jokes aside).

marine1: how do you know the guy didn't have the intent to kill, cos he said so? Someone has died in unnatural circirmstances, its seems reasonable that the plolice investigate to see whether it was an actual housebreaking.
