Actually from the court ruling this isn't true. Trying to change the law to allow for a president to not be charged would be politcal interference in the prosecution of the law - and that has been declared 'illegal'.
The NPA doesn't have any choice other than to prosecute Zuma. If they don't , they admit that they were only doing it for political reasons.
A slight aside - what high profile case doesn't have 'political interference'? Get some politician's grand daughter beign murdered and next thing Bushy Engelbrecht is on the case. So here is the thing - more resources are made available, better cops, more media coverage, etc and the guy gets caught. He can now go and argue that but for the politcal interference he would be free as the normal cops are usually too inept to catch him, or the prosecutor who would have handled the case would have been less experienced.
I listened to Chascalson (spelling?) rambling on the other day on 702 about the death penalty and how unfair it was because someone who could afford decent defence lawyers would not be hanged, yet those that got legal aid may well get the suspended sentence. This, he argued, made the sentence arbitary. Let me just say that exactly the same thing applies to jail time. Get a good lawyer and you'll get a lesser sentence - and that makes jail sentences arbitary and unfair. So just as he argues for abolishment of the death penalty he also argues that prison is unfair. Judges aren't that clever.
