Dubble jeopardy law : no person can be charged twice for the same crime, doesn't matter how guilty he is or what other evidence is brought forth , not a matter of right or wrong is a matter of principle in the law,
This is a american law in Sa we have a similar version but its not as black and white as this one
 
Double Jeopardy only applies to murder, I think. I dunno - been a while since I watched Fracture. And technically, Zuma wasn't acquitted of his crimes - the trial was scrapped.

I don't think the NPA will try again. And if they do, well, it'll make for entertaining television, I guess.

Not only murder anyways If they try to trail him again I'm sure he will have loads of law tricks up his sleeve.

I think you mean, tried, for the same crime. Zuma has never been tried.
A charge is not a trial.;)
 
Double jeopardy entails that, once you have been tried on a particular charge, and the court gave a verdict, you cannot be tried for that same act again.
 
No, the state is too scared to do this again since they have to pay the last ones legal costs and such...

This guy will get away and become our next president... CORRUPTED ;)

Then again, the Italian pres is more corrupted than Zuma ;)

So fact is : Zuma Cannot be tried , charged or whatever for the same case, they will need another rape case to get him locked :P


We honestly need to put this double jeopardy issue to rest.

A plea of autrefois acquit is allowed in SA Law. This means the accused person cannot be TRIED twice on the basis of the very same set of facts, notwithstanding the fact that it is due to procedural error or incompetence on the part of the State.

The CRIMINAL PROCEDURE ACT 51 OF 1977 provides as follows in Section 106 thereof -

"106. Pleas.—(1) When an accused pleads to a charge he may plead—
(a) ...
(b) ...
(c) that he has already been convicted of the offence with which he is charged; or
(d) that he has already been acquitted of the offence with which he is charged .... "

well there you have it, zuma so far with 2 cases against him is a innocent man, doesn't matter what his being accused off, hmm I see a legal pattern here.

Hi all I will ask for the mods to poll this in a second, but in the meantime lets see what the local myadsl populous thinks will happen.

Q: Will the NPA recharge Zuma.

It all depends on what type of batteries Zuma contains and
what his present charge level is. Even if Zuma is full
of it, if he's on Lithium Ion he can be recharged without
risk of any memory effects. If he's a NiCad guy, well
he'll have to be discharged completely first.
