Adult SMS Spam?

Putting this under Vodacom because both the numbers seem to be from the Vodacom network - and its not likely MTN would respond anyways :p

I received this message the other day from +2782004850000036:
Dozens of HOT & HORNY CHICKS are on the line right NOW!! CALL & CHAT LIVE!! on 0822399325

No opt out - and I have no clue where they got my number - consider I'm currently, and unfortunately, on the MTN network. :(

Are companies such as the sender of the above SMS allowed to send such SMS's without knowing the age of the receiver? What if this was some 9 year old's phone?

Again, only putting this under Vodacom cause it came from the Vodacom network - so maybe someone from Vodacom can give more detail about this...
 
would be interesting to hear if we can find this perp... wife also gets similar to these...
would like to take his S&M whip and smack his azz on fire! :p
 
Its apparently a company called "Strike Media" - I've asked for an indication as to whether it is legal to send adult SMS's to unknown recipients, which could include minors. If not, I'm off to my local police station - tired of spam.

Ive been getting totally random spam too!

Got some random dating sms - which had a stop number. Thought WTF this come from, so send STOP.

The next night - an Adult thing at like 2am saying I have been charged R20 and had a link below it. Didnt go into the link obviously, but it did have a number to send a message to, to STOP. So I sms'd the stop thing to the number....

I few days later, same message. Then again the next day. R20 being charged each time. There was a JHB number, so phoned it - got redirected to some british customer care centre. Gave the guy all hell - asking him where they got my details. He told me that I had sent a message to subscribe, but the amusing part is when I ask for the date and time - it was AFTER i received the first sms. So they were spamming me BEFORE i supposedly signed up. Give him more hell about the R40/60 - apparently they are sending me a cheque...ya right!

Then a few days later...and I have saved these one's for future fighting with MTN. Get a message saying I have reached "SMS Dates" and gives me details on how to get started. Then apparently I signed up to "Club Zed" for ringtones etc.

WTF....I am told that the ONLY way that they can sign me up, is if I send them a SMS. Something seriously dodgy going on here...
 
All totally illegal.
The sms must have an idication of cost of the service.
The sms must have an opt out feature at a max cost of R5
The sms cannot be delivered between 20h00 and 06h00 ( i think)
If you are being billed that R20 or whatever for them sending you stuff then they also have to send you a sms every month telling you that you are subscribed to a service.

Take all your incidents and report them to waspa.co.za, they have the power to fight it for you
 
oh and those are only the violations that i can think of from the top of my head
 
WASPA have gotten back to me, and I have asked that this become a formal complaint - I feel the company, Strike Media, is in breach of the following to Code of Conduct terms:

8.1.3. Members must take reasonable steps to ensure that only persons of 18 years of age or older have access to adult content services. Explicit confirmation of a user’s age must be obtained prior to the delivery of an adult content service.

Strike Media have never confirmed my age.

8.1.4. Marketing messages (including commercial communications) may no longer be sent to a customer of an adult service if that customer has not made use of the service during the preceding three months. This is to prevent the accidental marketing of such services to children as a result of a recycled telephone number.
I have never used an adult service - so the three month rule is long gone - I have had this cell phone number since 2001.

so - lets see what happens.
 
An update - WASPA has ruled in my favour, a fine of R150,000 has been imposed on the offender.

WASPA might take their time, but they rock.

For interest sake, the IP came back with proof that I used their services in 2004 - I wasn't in the country (At the time) in 2004, but my roommate did have access to my phone... I also don't have bills going back that far to verify.

I am chuffed with the ruling!!!!!!!!!

Wish I still had my 2004 bills so I could see if it actually happened - I still don't believe it happened... a roommate had access to my phone and my girlfriend... thats it
