All MWEB users have technically contravened the T&Cs, so when are they coming for you?

They do this to protect the service for the other 99.99% of paying customers who do not contravene the T&C.

The service contract exists between individual users and MWEB, not other users. MWEB cannot deflect responsibility for their own network onto individual users.

So, are you saying that MWEB's T&C's are in contradiction
to their advertising?

You can't say "unlimited" in an ad and then delve into the
T&C to limit internet use when you feel like it!

I think you'll find that you can. There are always T&C and they always apply.

In fact, the response to most of the posts on these forums relating to MWeb "complaints" is simply "Terms and Conditions Apply".

I don't think you really understand what he was trying to say. The fact is, if the T&Cs contradict or are ambiguous to the service as advertised (including public statements) then I'm pretty sure that ASASA will find in favour of the consumer since it is MWEB who is responsible for the confusion. Same goes for other civil action.

In fact, the response to most of the posts on these forums relating to MWeb "complaints" is simply "Terms and Conditions Apply".

It's very simple - if you don't like the T&Cs attached to a service - don't use it. Get something you like.

Slowly but surely my UNCAPPED UNSHAPED is starting to perform worse and worse each day, right now i am not even getting 20k/s from both an http download AND a newsserver download TOGETHER.

Mweb, i hope there is some type of glitch but the second i drop under 2GB/day i jump ISP's

With vague terms, who knows what is considered abuse, it could be 500GB today, tomorrow it could be 50GB. Honestly most people who do a lil bit of Skype, YouTube, email, WWW and FaceBook will not use more than 5GB/mo. I propose that anything above could be abuse.

Its going for.... <what-MWEB-randomly-decides-is-uncapped> for the month.

Oh wait - I forgot - its at their sole discretion according to the T&C's.... can't wait for vehicle/tv/home appliance/anything manufacturers to catch onto this term (which are apparently more than fair, cause its all our money is worth) with their warranties.... so how many geniuses will think its still 'fair' then, because its what they deem 'low-cost'?

I must of missed the part where perceived low cost service had dictionary altering capabilities, Uncapped = banned = because we're covered by T&C and sole discretion clauses.

True though :)

This has little to do with the service they're offering, and a lot to do with their contract which is heavily in their favour, and as far as I know, contracts are by law meant to be fair to both parties.
