MWeb has responded to these issues in detail on many occasions in several threads. Bypassing shaping is in contravention of the T&C on the shaped account, obviously. Constantly downloading unshaped protocols (such as HTTP) at maximum line speed 24/7 for the entire month is also in contravention of the T&C.
Unless you have purchased the shaped "Home" account with the express purpose of downloading hundreds of GB every single month, none of this should affect you at all. Beware of trolls on these forums who spread FUD.
Will I be safe if I http-downloading stuff at a good 384K line (By good I mean constantly at 40kb/s - +80% of 384K line speed) for 20 hours everyday?
Some maths stuff:
x = any amount of hours in a day. In other words, (x >=1 and x <= 24)
40kb/s * 60 secs = 2.35mb
2.344mb * 60 minutes = 141mb
In my case - Let x = 20:
20 hours * 141mb = 2820mb in a day
28 days * 2820 = 78960mb (77.11gb) in a month
This should be no problem, right?

384kb lines = no problem for MWEB. 4mb = big problem. MWEB did not expect 70000 (their figures) new users, most 4mb customers. MWEB buy a XXXXXX-amount of bandwidth, and currently they exceed this by far, and they have no choice to boot the heavy users.

Where did I say that 92GB is in contravention of the T&C?
I can't comment on the calculations. MWeb has not provided an exact cut-off as to what is acceptable and what is not.
If you want to download 20 hours a day every single month, MWeb will suggest that the unshaped "Internet Addict" account is better suited to your needs. It's also more expensive of course.
MWEB should have allowed for the greedy ones.
You don't offer unlimited, uncapped and then hope
and pray someone doesn't take you literally.
MWeb should have offered 20gb/40gb/80gb/120gb capped accounts at really good prices instead of uncapped ones they offer us which suck (according to most users) because of shaping.

Is it uncapped? Yes.
They've taken a leaf out of Cadbury's book. Reduce the size of the 100g bar to 90g
and maintain or raise the price.
They hope nobody will object. When they do, just claim that they were giving too
much chocolate.
Soon, we see that Nestle is making an 80g bar, which is their new standard.
MWEB gets away with changes and the other ISP's see them getting away
with it and follow suit.

The network can easily handle a few "greedy ones". The part that it can't handle is 100s others seeing that others can download 100s of gigs without consequences & then following suit. i.e. Allowing a few "greedy ones" establishes a precedent for what is considered acceptable.MWEB should have allowed for the greedy ones.
