R200 per GB Mweb ADSL complaint - case closed

The problem isn't Mweb, it's the people who choose to have Mweb as their ISP.

Well done, Vie. You may not have won the case but you did force MWeb to amend their web page. Short of calling them crooks, the adjudicator was also fair in this matter.
 
If you're still with MWEB after this, then you simply deserve to pay R200/GB oob rates.

Has ISPA ever found in favor of a complainant?

If it is a takedown notice. Yeah. They are fast to act on those.


Im not sure of the value that ISPA offers its subscribers. Beyond some limited legal support. The only reason I havent signed up with them yet is because I dont want to have to comply with their takedown notices. As a member you are required to comply. And from personal experience they seem to have a shoot now, ask questions later attitude to this. By not being an ISPA member the only institution that has the power to take down one of my clients websites is the South African judicial system.

this is not a correct understanding of the law or how the take-down notice procedure works - ISPA does not respond to take down notices but acts as an agent for its members in receiving them and checking they are legally valid. If they are then ISPA sends them on and the member chooses how to react. Contrary to what you say this does not always result in the content complained about being removed - iirc it is about 80 / 20 taken down / not taken down

the procedure - set out in Chapter 13 of the ECT Act - is not only applicable to ISPA members and would not be of much value if it was because then it would not apply to Vodacom, Telkom, MTN, Cell C and other large telcos who provide ISP services. if you as an ISP receive a take-down notice you have a choice - (a) take the material down and notify your client, in which case the ISP will not be at risk of being held liable as a publisher of that material or (b) refuse to take it down, in which the ISP may be at risk of being held liable as a publisher
