ICASA to revisit ADSL regulations, may address ADSL pricing

we need 30 tracy cohen's to staff icasa - someone please clone this rare example of competence at the Regulator

- in a number of seminars, conferences etc ICASA have come across as being almost desperate for industry input - we really should not disappoint them
 
*ponder* not sure how this gonna go but some things in there need to be fixed and finaly some clarity on the ADSL rental issue, who controls local bandwidth etc
 
On the one hand this is good news.....I just hope it will not become an "imminent" or "next friday" or "gvt printers" excuses/issue again. Please ICASA, just do it and enforce it!

May? For goodness sake people, if you don't address ADSL pricing, the last 2 1/2 years of waiting has been in vain! All the work that went into the hearings will have basically been for nothing. Our biggest problem is clearly about pricing!

ICASA infuriates me! (Can you tell?) They have taken 2 1/2 years to deliver a shoddy, unhelpful and unclear result. This can not be blamed on being short staffed.

ICASA is the laughing stock of the country. They clearly have egg on their face and are now trying to back peddle. I say the only way to get the egg off your face is to get out of the pan with the bacon aka Telkom and do your job of protecting us!

While you're at it, please ask Telkom to write out a cheque for R10 000 to me as a refund for the line rental I've been paying for the past 2 1/2 years which has in theory been stollen from me.

ICASA, do you realize that every month you delay these results, Telkom is being allowed to steal from us?

can someone start an official thread where we put what we want, and then someone can mail it to ICASA. All I want is true unmetered uncapped unshaped local, a 10gig international (minimum), and not pay for the ADSL portion of my line rental. Other than that I am pretty happy.
 
Cohen said that ICASA will do their best to respond in matters where there are grey areas and where clarification is needed.
Stupid JB. Everything about the regulations are grey that is why Telkom announced how great the regulations are. Telkom haven't changed anything and they don't have to!

An ISPA member also asked why ICASA did not clear up the regulatory confusion that is currently paralyzing the market. Cohen responded that at the moment ICASA was facing huge staffing issues, but is taking note of this issue and that ICASA become more pro-active in future.
Pro-active ICASA. Now that's a oxymoron if I've ever seen one.

A core regulation should prohibit a bandwidth wholesaler to be a retailer as well.

Eg: Telkom as wholesaler may not be a retailer (TelkomSA.net).

Add to this an implementation roster: TelkomSA may continue to service exisiting ADSL customers, but may not add new customers.

Existing customers will be allowed to increase their purchases from TelkomSA.

Now this would force something new onto Telkom: Customer retention!

Quite frankly, we should be getting nothing less than that.

I still believe there should be no cap at all. But I will be satisfied (for now) to pay R200 (all inclusive) pm for uncapped/unshaped local and 10GB international.

Would it not be better if we all mailed ICASA with our complaints/concerns? Then again, if more complaints means they are going to take longer to address this matter, I'd be happy if we send one letter from MyADSL as a group.
 
With all due respect, if ICASA couldnt grasp and deal with the fundemental issues the first few times, they sure as hell are not going to do it now.

They move at the pace that the DoC dictates.
 
If ICASA can only address the ADSL pricing module at this stage it would be a start.
Capping would become much less of a concern when the price per Gig comes down, together with ADSL access charges, as consumers won't be bothered purchasing additional bandwidth if the prices were reasonable.

How Telkom fails realise that if they drop their charges for ADSL/Bandwidth/Gigs, people will surf more and buy more access from them, is beyond my reasoning.
Pick n' Pay have been using this approach for years and from what I can tell, they aren't bankrupt by a long shot!

They have become desperate for input of hard factual information, the same information that only Telkom holds and Telkom will NOT supply them or the public by citing confidentiality and competitive advantage reasons. This is what happened at the hearings. Just look at the ISPs. They have to sign confidentiality agreements with Telkom!

ICASA played it safe by releasing the most unclear regulations they could have because they think they have no hard legally usable facts on how much profits Telkom are making on ADSL and how much it costs Telkom for the various parts of provisioning ADSL.

The industry is doing the only thing they can by complaining about telecoms in the press. How can we possibly give ICASA more input? ICASA are just too lazy to do their own research, too stupid to realize Telkom is a monopoly and too naive enough by thinking government has the industry's best interest at heart.
 
Tracy Cohen, an ICASA councilor, urged interested stakeholders to approach the Authority with their concerns regarding the regulations and suggestions as to what should be done to improve on the current situation.

erm has this not happened already after the release of the draft regulations? Was this not the reason why the regulations were postponed in the first place? Then the DoC got hold of it and look how it ended up. Here we go beeting around the freaking bush again...

how would this help? Not like there are signs from Telkom they are doing anything about the current regulations. All they said was they welcome the regulations but that's all...I hope ICASA starts defining penalties to Telkom if they don't abide to the regulations.
 
Invite her to join the forums or place a representative on the forum. It's likely the most lively pulse on the feelings of the public, failing that we need someone from the DOC to join. All the input on this forum, the expertise, the opinions etc should be reaching the people that could actually make a difference.
 
I have to add this, call it the conspiracy theorist in me but....

The more I think about it and look at the situation unfolding, it's almost as if a Telkom official went about making these "reforms" in the best way suitable to Telkom but yet to be seen as making change happen. It almost makes sense that Govt would allow Telkom a say in how the future landscape of Telecoms should be shaped in SA. ICASA really needs to get some bite and act like a regulator and not just another inefective organisation.
 
I am not sure why Telkom not supplying [costs] data is a problem.

If SARS decides that you have waxed poetical with your tax return they decide on your taxable income and levy taxes accordingly: it is then up to you to prove otherwise.

Surely ICASA could apply the same rule to Telkom?
