2004 ICASA complain

It has been a bit quiet. Whats up people?

Hi Karnaugh and BTTB

I send through some basic feedback from the Telkom response to Dianne on March 12 2004 and was informed that she will be asking for a public hearing regarding the ADSL service. Since then I have not heard anything from them. She did warn me that this step can take a great deal of time, but I will contact them on Thursday to find more details about the progress. As soon as I get any more information I will post it in this thread.

Hi folks

I have heard back from Dianne…the complaint is now being escalated to the next level where the ICASA council will decide on the validity of the complaint etc. I will keep you informed about any progress.

Now we will see if Telkom really does have ICASA in their back pocket.

There is no possible way they could find that this complaint is not valid. I look forward to the outcome. Thanks RPM!

Wouldn't be surprised.

Without being pessimistic, ICASA answer to ANC, ANC have a stake in Telkom.

Why do I get the feeling as if they are stalling...

Don't they know by now this is not going to go away through ignorance?

This is known as due process. It takes time. Have you ever been involved in a legal dispute? Hell, even sueing for maintenance can take months.

Don't bring political parties into this - we've had enough politicking over the past few months. Admittedly the Government majority is ANC, but this is a policy issue that crosses political boundaries, and where policy short-sightedness affects us all. My understanding of the telecommunications principles currently being punted by those political parties which actually have one, is that they are all essentially the same. The problem lies in the execution, obviously, and this is where the nub of the problem lies...
 
I must agree. I was in two minds to contact KFM and challenge them to have one day dedicated to Apsolutely No Advertising. Im sure they made millions the last month or two with all the political parties.

when telkom says that only a few ppl are actively unsatisfied with their services (and has replied that most adsl users are happy) it kinda invalidates our complaint...

i have this idea, but dunno if it'll fly.
Why don't we make a new complaint document, exactly the same as the first one, but this time, instead "signed" by users using their adsl username, eg. [email protected]?

You think that could work?

Potentially a good idea, but it would probably be wiser for the public hearing to take place first, as this would certainly indicate the scope and extent of the complaint against Telkom. Lodging another complaint will merely mean another long drawn-out procedure in terms of due process...

Just to keep you informed about the correspondence:

"I've been requested by our General Manager- Ms J Naidoo that I should advise you that Ms Dianne Ngoasheng- Senior Manager Consumer Protection Dept. is the one who is attending to your complaint, and at she would be back at work on Monday- 26/04/2004. We are therefore not in a position to acknowledge receipt of your latest correspondence to her. What we can confirm is that all complaints regarding ADSL have been escalated to Council , for resolution on the way forward."

Not a bad idea Cosmic, though you would then be excluding people like myself who are making do with older technologies (ISDN) for various reasons, all outlined in the original complaint.

You guys are fighting for the right thing - this is a battle between good and evil. Keep up the good work and good luck.

I would like to suggest that you have to do some more research in terms of their pricing structures (Calling all spies and informants). Questions that I think needs answering:

1. Does or doesn't the R680 include the SAIX 3GB bandwidth? If so:
2. Why do MWeb ask R329 for ADSL when you use SAIX (Telkom bandwidth) anyway? Remember it is SAIX that is imposing the cap. So if you are a MWeb subscriber with ADSL you pay more than a dial-up user (R145) and get the same thing (mailbox, value added services), but they have fewer expenses i.e. no POP modems and bandwidth cost. A MWeb select account (R79) is more appropiate (Maybe Tiscali (R319) can also help us to answer this question)
3. Why do you pay Telkom Internet R249 per month if all you get is a pathetic POP3 mailbox with 5 aliases, AntiVirus and AntiSpam and authentication services (all done with freeware)? Telkom Dial-up users pay R79 per month and use SAIX dial up POPs.
4. Why can you get an ISP ADSL account from somebody who knows somebody for R100 per month?
5. What do MWeb and Telkom Internet and somebody who knows somebody have to pay SAIX for the ADSL account? I think the answer is nothing - it is pure profit. (After providing a mailbox and authentication services)

This whole thing smells of cross subsidizing and friends protecting friends!

The Telkom evil empire will fall. Remember World War 2 was only 6 years and people in that war believed it was the end of the world. We will look back at this and say: Remember how the monopoly crumbled?

I think this is one of many injustices against the South African public. Another one is TV licenses. If you look at the TV license law, it is ridicules: It is like a tax, but the money goes to the SABC because you have the ability to receive a radio signal in South Africa (whether or not it is theirs) – meaning all MyWireless subscribers should make sure their TV licenses are up to date or is the license fee already included in the monthly subscription? [:)]
 
Wow you really should stop reading conspiracy theories [;)]

1. Firstly the 3GB cap is imposed by Telkom not SAIX, while Telkom owns SAIX they are separate entities. The R680 paid to Telkom only includes the line rental (or so they would have you believe).

2. All ISP's are merely resellers of Telkom ADSL accounts. They purchase the accounts wholesale from Telkom and add their mark-up. M-Web are slightly different from other ISP's with regard to ADSL as they have their own authentication servers. This means they can change your password without needing to go through Telkom however you still use Telkom's bandwidth.

3. You don't have to pay SAIX anything, you are free to go with any ISP you like. In fact there are some offering ADSL accounts for around R200. It's all a matter of personal preference.

4. ??? you'll need to elaborate on this.

5. Not sure what they purchase the accounts for but again it's from Telkom not SAIX and I'm pretty sure Telkom are not giving them away for free to ANYONE.

While Telkom is evil I don't think they will be wiped out completely, they have grown far too big and have far too much cash for that. They will probably change their service offerings (even if unwillingly) as competition slowly filters into the market. It won't be an overnight process but it's happening.

TV licenses you only have to pay if you have a TV... seems fair enough to me as you can't say all the programmes on the SABC channels suck entirely [;)] I don't know where you draw the parallel with Sentech and TV licenses but no it is not included in the monthly subscription.

Ok I'm done, hope that's cleared up a few things for you and you can take off that tinfoil hat now [:)]
