@Afriman, I presume on the grounds you canceled my account, should you not cancel Savage's account too?
 
I never said that no-one has a right to be angry or frustrated. I know that many people are. I think that shows that there is no precedent being set, and this is a specific incident with it's own set of circumstances.

where those circumstances in breach of you T&C's?
 
So does this mean that you in your personal capacity ( and not Afrihost as a company) decided that the relationship has reached a point that warrants an immediate cancellation?

As I've said there was a break down in the relationship, and it was clear that there was no way forward to proceed with a reasonable business relationship. Fair notice and compensation are being provided to the client.
 
No, AfriMan has if he cancelled your account. Apparently you're the only one who is meant to have permission to carry that out.

Nah, they have every right to terminate the contract within the terms set out in the agreement (which is why they require it to come from the control panel from the client, as it constitutes formal notice), which will afford Afrihost the right to cancel with 30 days notice. Such a notice is a legal document, as it ends a contractual obligation for both parties. PM'ing what amounted to a threat about cancelling jeanres' account does not constitute a legal notice of termination of a commercial, legal agreement.

The reasons provided by Afriman are also ridiculous, as jeanres can prove that he attempted to find a resolution to the matter in private and agreed to stop posting negatively about the company if they can come to an agreement. There is also no expectation of trust that a customer will not post negatively about their experiences, so the reasons are quite stupid to be honest.

So what we have is a situation where Afrihost appear to be in breach of contract, yes. They have terminated the agreement without proper notice. IANAL but the reasons given for the termination would probably not hold up if jeanres challenged it legally, although Afrihost would simply terminate it in any case. I don't think they need to justify their actions in this respect, but if they choose to do so, which they have, it might need to hold up legally.

At the end of the day this is just a customer service balls-up, and an inevitable one considering how oversubscribed Afrihost are. It was always going to result in something like this happening. It didn't have to. At the end of the day Afrihost have a lot of happy customers. They're typically subscribers who don't know better, and are easily fooled when they complain, and are told that it's a Telkom issue. That's the bulk of their subscriber base on the ADSL side of their business, so this incident and the IPC issue is hardly going to cost them anything on their bottom line. That might explain the 7 month delay...

The question remains: are we as customers willing to be bullied by afrihost or are we going to stand together and vote with our wallet?

Are we going to support this or are we going to start a mass exodus away from afrihost.

The problem is that only around 30% of their user base follows this forum.... so we are but a drop in the ocean for them, and that is why I will take this further then mybroadband

I'm pretty happy that we've made the right decision and I'm willing to stick by it. I do regret that it came to this kind of ugliness, but it's par for the course, I guess.

It will be sad to see you leave, but I honestly wish you the very best going forward :)

I'm contemplating that decision right now.

Given what it came too - is it not evident to you that you took the wrong decisions? Because it's as clear as daylight to everyone except Afrihost...
 
ISPs seem to have the same problem as Eskom, they can't manage the peak loads. Fortunately there is more than one ISP but the critical mass will just shift to the next poor, unsuspecting ISP.
 
@Afriman I am not fighting this just for me dude, I am fighting this for every customer of every ISP, so that we do not have to tolerate this in the future.
