Altech / ICASA case - Judgement 28082008

I really doubt government(read really big Telkom shareholder) will allow this. Will have to wait and see I guess.

What can I say, experience taught me not to take local telecom "developments" too seriously. Like that time in 2004 when the minister said...

Anybody remember Future Imperfect

We are talking about an impeccable judge here.

Does anybody remember Judge Denis Davis who presented "Future Imperfect" on TV during the early 1990's

This is the same judge today who heard the case, and who could not have gone any other way.

I was quitely confident that we would have got the ruling we got when I heard who the judge was.

His tagline on Futue Imperfect was "and you be the judge" - Well sir, I can only agree with you.
 
Now only we need to deal with Spectrum Issues !

But may i bother you for just one more thingy !

The spectrum issue !

How can ICASA allocate GSM and UMTS spectrum for Telkom to roll out in Select areas ! When all the other areas are neglected ? That part of the Spectrum is wasted if not used in other areas where they choose not to roll out Towers !

How can ICASA reserve UMTS 3G spectrum for Cell-C when it has no intention of building a WCDMA network !

How can ICASA throw Various Bands of spectrum at a few operators ?

ICASA needs to refarm the Spectrum Bands and do it as a matter of Urgency ?

I would like to leave that Thought with you guys at Altech !

Who knows ? Maybe another Court Action will stop ICASA giving lotsa candy to its firstborn !

there is currently a review of the sa band plan & it looks like quite a lot of frequency has been freed up for wireless access services which is good to see

submissions are due 12 september.....

Lets just hope a full bench or the SCA doesn't get to hear this matter and this craziness ends here...
 
From the ruling it looks like ICASA/DoC lost with costs...is this correct Dominic?

yip...not a very complimentary document for either the Minister or ICASA
