Annual Leave and getting sick

Hi,

hope that someone here knows...

If one takes his annual leave, say 3 weeks, and falls sick during that time, will the leave days be credited? Would it be company policy or labour law?

I know that at least one european country will credit the days, because its recreational leave, not sick leave.
 
Never thought of that concept, my initial thought would be no - you're on leave, your company generally couldn't care less what happens to you while you're away? Ultimately I suppose it depends on company policy - check with your HR (or similar) manager?
 
yeah doctors certificate and they should credit the leave as far as i know, and that is labour policy afaik
 
I looked at the date on my PC to make sure it wasn't the 1st April.... Really?

I don't see why a company would do that or should do that. I mean thats your annual leave & what happens during that time is your business. And no, I don't work in HR & nor do I own a company so don't think I am looking at this from a company perspective.

I have never heard of a SA company who does this nor a friend who came right trying this & I would be very surprised if it is true.

Please post something from the BCEA if you find anything out.

quite a few do. PERMITTING you went to the doc & got a sick note, the same as if you were at work.....
 
This means for example, that if an employee is on annual leave, and he falls ill during that period of annual leave, he can visit the doctor and if the doctor certifies that he is unfit for work for a certain period of time, then upon that employees return to work from annual leave he can hand the medical certificate to the employer, and the employer must credit that employee’s annual leave with the number of days sick leave, and debit the employee's sick leave.

Maybe you can ge 'credit' for those days with a sick note but how on earth do you ever expect to get a raise or a promotion with that approach to work.

Employers don't like to see you trying to exploit them at every turn for your own gain - it's not a good long term strategy for your career.

it is the law... just like there are laws about taxes ......

you often find that there are people that never get sick while at work & when they take a little time off they get ill. While others around them take regular sick leave & are not ill while on leave.

I agree man. Its like sick leave. You are entitled to so many days / month / cycle & just cos its there doesn't mean you should take it, not unless you want the company to take you seriously WRT to climbing any laddrer within the company.

I worked for 2 different SA companies and it WAS policy to credit your annual if you fell ill during annual leave and supplied HR with a doctors certificate on your return.

Sure it's the law but when it comes time for a salary increase or promotion you don't think the boss is going to pick someone who goes the extra mile over you?

Someone puts in a bit more effort over someone who tries to take everything they can from the company?

I know who'd I'd want on my management team and it isn't someone who's petty enough to try and claim their sick days from their annual leave.

It sends all the wrong messages about your attitude to work. So stick to the law but don't expect to move up - you'll always be a low level worker unless you start to take your work seriously.
 
happened to me in Jan while I was on leave, got sick, went to the doc who 'booked me off' for three days... got the three days credited to my annual leave...

yeah to a point i agree, i personally wouldnt try get leave credited for having the sniffles for a day or two but if i am seriously ill for like a week i would probably use it.

slow down there..

Often those people who get sick while on leave are the ones that are there rain or sunshine & are always willing to go the extra mile, so why not give them back their ill time?

You're picking on one of the worst people here - I am self employed.
