Annual Leave and getting sick

yeah to a point i agree, i personally wouldnt try get leave credited for having the sniffles for a day or two but if i am seriously ill for like a week i would probably use it.

If you take 2 weeks leave & your appendix plays up on the second day it surely won't make for a great holiday....
 
Personally I think its cheeky, but thats the law.

There is an attitude with some of my staff that they have a right to take sick leave even if they're not sick. I now have to demand a sick note for everything.

Came back to bite my mother in law in the ass tho. She took every excuse she could to use up her sick leave (including claiming some of her leave as sick leave) and then in November she really was sick for a week. She had no sick leave and no holiday leave left so I made her take unpaid leave.
Now in January she took a week again and I gave her 1 day and made her take 5 days unpaid again. She was under the impression that because it was a new year her sick leave would have reset to full. She was dismayed and almost in tears to find that it does not.

She really is one for "Ruck die poephol uit die hoender uit" (is that spelled correctly?)

Can't remember the days exactly....

But if I recall. Your sick leave is spread across omre than a year, so people do need to be careful with it. There is no point in wasting it, however when it is really needed & there are days I see no reason to deny it.
 
I have almost never taken sick leave. Headaches and sniffles are part of life and I go to work with them. But, I agree - if you got something during annual leave that would have caused you to take sick leave during normal working time (operation, or serious medical condition or whatever), I would expect my company to credit me the leave.

Remember, annual leave is there to rest and spend time with family. I won't work for a company who doesn't respect this and doesn't give me promotion because I claimed back my annual leave - especially if it is company policy.

Furthermore, I don't respect a company who allows somebody to build up their annual leave for 2 or 3 years and never takes any leave. There's more to life than working - and a company should know this as well. There's a reason why the labour law forces you to take a certain amount of leave per year. Sure, it is a different story when the company is under stress or has limited resources, or there's difficult deadlines etc., but giving up leave is not, in my books, a sign that I am loyal to the company and want promotion. It says "I am a workaholic and have no idea what to do in my spare time".

I think it's 30 days over 3 yrs but my memory is not so hot.

Maybe you can ge 'credit' for those days with a sick note but how on earth do you ever expect to get a raise or a promotion with that approach to work.

Employers don't like to see you trying to exploit them at every turn for your own gain - it's not a good long term strategy for your career.

its not the approach to work that measures, its your knowledge and worth to the company. If I really fall sick, and I am not talking about a cold or headache, then its in my opinion not annual leave that should be taken off. Thats why one can take sick leave.
And no, I am not one of the people that runs to the doctor for everything so that i could score a few days off (app. 20 days off due to sickness in 24 years is not much, isn't it?)

But great responses so far, interesting views and also got a reference to the labour law :)

Btw, in the european company I mentioned this has never been a discussion, its based on the laws and rules being negotiated between Unions and employers and has nothing to do with increases or careers.

Guess I'm currently a little tetchy on the topic as I've got one little runt working for me who takes sick leave at the drop of a hat. And every year he miraculously manages to take the exact number of days due to him.

Waiting for the day he posts on Facebook that he was out jolling at Gold Reef City on his sick day :).

But it's these good for nothings that ruin it for everyone. If you're geniunely sick - like can't get out of bed sick - then call it. Just don't be a real a@se and milk the system.

I also hate it when really sick people come to work full of snot, coughing etc. rather stay at home. I see someone like that I go and do something at remote sites I've been putting off to do for a while and go on a road trip just to get away from them :D

Not really - I like people on my team who are keen and work hard. I've had tons of knowlegeable chaps who try to breeze through the job just like they did school and it only takes you so far and no further.

A good attitude goes a long way :).

Yea, but it builds up over time to a maximum of 36 days over 3 years. You basically get one day a month.

Now that annoys me too. I have often sent people home for coughing on me.

what contract did you give the guy? standard as per the law 30 days per 3 years sick leave? if so let him use it in a year if he wishes, thereafter it will at into his annual leave & then over to unpaid... he won't like his pocket being hurt.
