Apple Inc., facing a ban on imports of its watches that generate billions in annual sales, is seeking alternate paths to overcome the patent-infringement loss that forced the most popular Apple Watch models off shelves over the holidays.

The Cupertino, Calif.-based tech giant won a temporary reprieve from a federal appeals court Wednesday, two months after the US International Trade Commission ruled the smartwatches infringed patents held by medical-device maker Masimo Corp.—and one day after the device’s US sales halted.

Does the "software to bypass" disable the hardware?
AFAIK there are different ways to get the measurements and Apple is using Masimos way (the most accurate) to get the result .

They’ll change the algorithm on the backend which will most likely lower accuracy or something - but it will still give a result . So to you or I, it’ll seem like nothing has changed
 
Why don't they push through an update that disable the function and delete the algorithms , the fan boys won't mind

It's clear from the article they don't have to, yet.

I'm wondering if/when they do whether a forced update will be US-centric or global.

Seems Apple was pretty scummy from what I heard. MKBHD shared that Apple approached Masimo to use their hardware, then hired Masimo staff instead and filed a patent under the name of one of the Masimo staff they’d poached. I wouldn’t call Masimo a patent troll if that was the case.

They’re absolutely not. He doesn’t understand what that term means though.

Masimo is a legit publicly traded medical technology company founded 3 decades ago, employing 8,000 people with a worth of $6bn or so. They supply medical products to hospitals & clinics around the world.

They actually acquired Sounds United as well, so they also own Denon, Marantz, Polk Audio, Bowers and Wilkins, Definitive Technology, Polk, HEOS, Classé Audio and Boston Acoustics

As you say, the real dodgy company here is Apple trying to use someone else’s product or technology developed over years using their own R&D. And when getting caught out, trying to get the President to overturn …

This is where I am hoping Apple loses this case. I enjoy the iPhone alongside my Galaxy phone, but Apple is very arrogant and seriously disrespectful. They have so much money that they think they can step on anyone's toes without consequences.

The Masimo patent is for hardware. Not sure how a software change gets around the patent... unless Apple use software to disable the hardware to make 0% accurate.

I've read the article, and i've read up on Masimo ad naseum and my conclusion remains the same. Apple didn't steal anything.


Masimo thought Apple would pay them quickly, Apple is showing patent trolls the door and rather sacrificing their product sales as a show of strength. I say good on them! I'de buy another Apple watch this year just to help Apple pull more sales and a finger at Masimo :)
