I've read the article, and i've read up on Masimo ad naseum and my conclusion remains the same. Apple didn't steal anything.


Masimo thought Apple would pay them quickly, Apple is showing patent trolls the door and rather sacrificing their product sales as a show of strength. I say good on them! I'de buy another Apple watch this year just to help Apple pull more sales and a finger at Masimo :)

As long as the trolls at Masimo never see a penny of Apple's hard-earned money i don't care if Apple pulls the entire watch and sells us an empty strap. I'll still support them. We'll see how it plays out, the injunction was a step in the direction of some logic and reason but its only temporary.

Massimo will definitely receive money from Apple as they used it for years, so will have to pay based on number of sales plus extra. Apple removing it is to limit the number of sales to that point in time, and hopefully mitigate the cost.

Apple hired ex Masimo employees - this is business, not a backyard BBQ with your buddies - people leave jobs for better ones - and designed their SPO2 monitor with the skill of that staff. Masimo alleges the one Apple designed is a patent infringement. There will no doubt be overlaps because the same techs at Masimo that Masimo could not even hold on to got jobs at Apple and designed their one. So there's overlaps in the technology that Masimo claims is patented. There is a patent yes, but there's only so many ways an SPo2 monitor can work - so at some point there was bound to be overlaps and when Masimo saw them they obviously were bitter at losing staff, and saw a quick way to make money. So they took legal action claiming patent infringement.

Apple actually did something with the tech, they put it in watches and saved lives. Masimo just hung around with the patent waiting for someone (because like i said, there's only so many ways to make an SPO2 monitor) to infringe and then pounced like trolls.

I hope Apple buries Masimo so far deep in whatever they have planned that their name is wiped from history :)

This isn't a groundbreaking invention. And I don't think it is even applicable to the Apple watch.

It doesn't even apply because the LEDs are in completely different locations.

With a finger pulse oximeter, LEDs shine through the skin and receive the light. With a wrist based one, like the Apple watch, it is based on the reflected light (hence why wrist trackers are less accurate than finger ones). So their whole argument doesn't even apply.

Let's assume you're right and you do know more than the attornies dealing with case.
  • Why would ITC even ban Apple watch in the first place?
  • Why would U.S. Federal Appeals only pause the ban?
  • Why would Apple start contemplating work arounds & changes to get past the ban?
  • Why are they looking at dropping the feature?
  • Why were they looking at running to the President ?


I'd think at some point someone would have said the below - but teams of very smart people are saying seeing merit & Apple is already looking for ways out ...
